The spectrum ranges from conservative New York to progressive Ohio.<\/p>\n<p>In the U.S. today, two main positions from a regulatory standpoint exist. New York has taken a stricter, more controversial stance towards blockchain projects while states like Ohio have adopted much more encouraging policy.<\/p>\n<h2>Conservative New York<\/h2>\n<p>New York City is home to Wall Street, the financial capital of the world. It is not surprising that Bitcoin and cryptocurrencies, technologies with the goal of reversing the need for \u201cfinancial institutions serving as trusted third parties,\u201d have drawn distaste from some of the leadership on Wall Street.<\/p>\n<p>Jamie Dimon, the current CEO and Chairman at JPMorgan Chase, has <a href=\"http:\/\/fortune.com\/2017\/09\/12\/jamie-dimon-beats-up-on-bitcoin-says-its-a-fraud\/\">called Bitcoin \u201ca fraud.\u201d<\/a> Another Wall Street powerhouse, the Bank of America, has accepted that crypto is a threat to their business, as stated in an <a href=\"https:\/\/www.sec.gov\/Archives\/edgar\/data\/70858\/000007085818000009\/bac-1231201710xk.htm\">annual report<\/a> to the SEC:<\/p>\n<blockquote><p>&#8220;In addition, the widespread adoption of new technologies\u2014including internet services, cryptocurrencies, and payment systems\u2014could require substantial expenditures to modify or adapt our existing products and services.\u201d<\/p><\/blockquote>\n<p>This skepticism and worry have caught the eye of regulators. To that end, New York implemented the <a href=\"https:\/\/www.dfs.ny.gov\/legal\/regulations\/bitlicense_reg_framework.htm\">BitLicense<\/a>, a regulatory framework that aims to provide consumer protection for blockchain technology and cryptocurrencies. <a href=\"https:\/\/cryptoslate.com\/people\/erik-voorhees\/\">Erik Voorhees<\/a>, the CEO of cryptocurrency exchange ShapeShift, had a harsh reaction to Dimon\u2019s statements about Bitcoin and <a href=\"http:\/\/moneyandstate.com\/reflections-right-privacy-response-nydfs-bitcoin-proposal\/\">criticized<\/a> the &#8216;know your customer' (KYC) aspects of the BitLicense calling it an &#8220;aggregated surveillance list&#8221;.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">My memory is failing, was it Bitcoin or was it JP Morgan that was bailed out by the government? <a href=\"https:\/\/t.co\/DHqFzr5UJN\">https:\/\/t.co\/DHqFzr5UJN<\/a><\/p>\n<p>&mdash; Erik Voorhees (@ErikVoorhees) <a href=\"https:\/\/twitter.com\/ErikVoorhees\/status\/907679079469654018?ref_src=twsrc%5Etfw\">September 12, 2017<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>He is not alone; Kraken, a cryptocurrency exchange based in San Francisco, exited New York over the BitLicense.<\/p>\n<h3>In a <a href=\"https:\/\/blog.kraken.com\/post\/253\/farewell-new-york\/\">blog post<\/a> from 2015, Kraken likened the BitLicense to a &#8220;a creature so foul, so cruel that not even Kraken possesses the courage or strength to face its nasty, big, pointy teeth&#8221;.<\/h3>\n<p>The primary source of discontent with the BitLicense stems from its hope to provide \u201cconsumer protection\u201d via a system that would enforce know your customer rules on cryptocurrency companies with customers in New York. This would include collecting customers\u2019 personal information. To some, this runs counter to what blockchain stands for: individual control of data and assets, and freedom from institutions controlling that process.<\/p>\n<p>Secondly, the process of acquiring a BitLicense has been less than popular with the blockchain community. As of Nov. 1st, there have only been <a href=\"https:\/\/www.dfs.ny.gov\/about\/press\/pr1811011.htm\">twelve companies<\/a> that have been granted licenses. This creates a barrier of entry for any new blockchain projects in New York.<\/p>\n<h2>Progressive Ohio<\/h2>\n<p>Cleveland, Ohio\u2019s second largest city, is less than two hours away from New York\u2019s southwest border and has been taking a very opposite approach to the blockchain.<\/p>\n<p>Through an initiative led by state treasurer Josh Mandel, Ohio became the <a href=\"https:\/\/cryptoslate.com\/ohio-first-state-to-accept-bitcoin-calling-crypto-secure-transparent-and-low-cost\/\">first state to accept Bitcoin for taxes<\/a>. This is important in multiple ways; <a href=\"http:\/\/www.legis.ga.gov\/Legislation\/20172018\/174462.pdf\">Georgia<\/a>, and\u00a0<a href=\"https:\/\/legiscan.com\/IL\/text\/HB5335\/id\/1732008\">Illinois<\/a>\u00a0have pending bills to accept Bitcoin for taxes in the state legislature, while <a href=\"https:\/\/legiscan.com\/AZ\/bill\/SB1091\/2018\">Arizona successfully passed<\/a> such a bill through the Arizona Senate and is waiting for confirmation from the House of Representatives.\u00a0These kind of initiatives could be the first step towards greater support for pro-blockchain legislation.<\/p>\n<p>Cleveland has the <a href=\"https:\/\/www.blocklandcleveland.com\">Blockland<\/a> initiative with the goal of \u201cestablishing and leading a blockchain ecosystem with support from private, public, and philanthropic individuals and organizations\u201d with support from the state\u2019s Governor, John Kasich. State Senator Matt Dolan has sponsored a bill (<a href=\"https:\/\/www.legislature.ohio.gov\/legislation\/legislation-summary?id=GA132-SB-300\">SB300<\/a>) which eventually led to Ohio legally recognizing data on blockchains. In the state\u2019s capital, Columbus, a Franklin County auditor, has <a href=\"https:\/\/www.dispatch.com\/news\/20180823\/auditors-use-of-blockchain-technology-touted-as-more-than-way-to-transfer-records\">planned to use blockchain technology<\/a> to transfer property deeds.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Great explanation of blockchain technology and the benefits that it can bring to Ohio.<br \/> <a href=\"https:\/\/t.co\/DjEHzuHny9\">https:\/\/t.co\/DjEHzuHny9<\/a><\/p>\n<p>&mdash; John Kasich (@JohnKasich) <a href=\"https:\/\/twitter.com\/JohnKasich\/status\/1062014143274868738?ref_src=twsrc%5Etfw\">November 12, 2018<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>Ohio is taking a very business-friendly stance that has been experimented with in other states across America. On the other hand, New York is not alone in using strict regulation to control the blockchain industry. Washington state, for example, has <a href=\"https:\/\/dfi.wa.gov\/bitcoin\">implemented<\/a> cryptocurrency regulation that could impede blockchain startups in the state.<\/p>\n<p>Although these two approaches run counter to each other, they also present the other 48 states with precedent on how to manage crypto and blockchain technology. It is clear which system blockchain projects like better, but at the same time pro-blockchain legislation may put investors and consumers at risk.
