{"id":91389,"date":"2018-10-31T11:00:53","date_gmt":"2018-10-31T18:00:53","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=91389"},"modified":"2020-04-06T01:19:07","modified_gmt":"2020-04-06T00:19:07","slug":"uk-report-warns-pms-not-to-crack-down-too-hard-on-crypto","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/uk-report-warns-pms-not-to-crack-down-too-hard-on-crypto\/","title":{"rendered":"UK Report Warns PMs Not to Crack Down Too Hard on Crypto"},"content":{"rendered":"<p class=\"p1\"><span class=\"s1\">A new report on cryptocurrency regulation in the UK warns that \u201cbad regulation is worse than no regulation at all,\u201d the Telegraph <a href=\"https:\/\/www.telegraph.co.uk\/technology\/2018\/10\/29\/regulation-could-backfire-break-uk-crypto-market-mps-warned\/\"><span class=\"s2\">reported on Monday<\/span><\/a>. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Experts cited in the report claim that an overly harsh crackdown on cryptocurrencies could break up the UK crypto market, causing companies to move to less regulated pastures to set up shop and dent the UK\u2019s reputation as a hub for fintech innovation and advancement.<\/span><\/p>\n<h2>Calls to Regulate Crypto<\/h2>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Novum Insights was in the Telegraph morning for our response to the crypto asset task force with our colleagues at Baker Botts, the BBFA and TodaQ <a href=\"https:\/\/t.co\/NhyvIOPXPx\">https:\/\/t.co\/NhyvIOPXPx<\/a><\/p>\n<p>&mdash; Toby Lewis (@tobynovum) <a href=\"https:\/\/twitter.com\/tobynovum\/status\/1056821771712774145?ref_src=twsrc%5Etfw\">October 29, 2018<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p class=\"p1\"><span class=\"s1\">The report comes as a response to a plan by MPs to use the Financial Conduct Authority (FCA), a UK regulator independent from the country\u2019s government, to enact stricter rules around cryptocurrencies. The FCA outlined these planned regulatory steps on its website and was part of a task force reporting on the state of crypto in the UK\u00a0<a href=\"https:\/\/www.gov.uk\/government\/publications\/cryptoassets-taskforce\"><span class=\"s2\">whose findings were published in July and updated today.<\/span><\/a> <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Four agencies took part in the counter report: the <a href=\"https:\/\/bbfa.info\/\"><span class=\"s2\">British Business Federation Authority<\/span><\/a> (BBFA), law firm Baker Botts, VC fund Novum Insights, and crypto exchange TodaQ. The BBFA\u2019s chief executive Patrick Curry described the proposed regulatory measures as a \u201cblunt instrument,\u201d stating in an interview:<\/span><\/p>\n<blockquote>\n<p class=\"p1\"><span class=\"s1\">\u201cIt is a very blunt instrument approach and I haven\u2019t seen this in other countries.\u00a0The use of this technology\u00a0is still a voyage of discovery and these technologies\u00a0are being refined\u00a0for different types of use. My concern is the law of unintended consequences.\u201d<\/span><\/p>\n<\/blockquote>\n<p class=\"p1\"><span class=\"s1\">Those unintended consequences include what could happen if all digital assets get lumped together under the same set of rules. Instead, Neil Foster of Baker Botts argues that a more sophisticated classification of digital assets is needed to determine what should and should not be regulated. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Foster argues that putting all crypto assets under the umbrella of the UK\u2019s Regulated Activities Order, which there have been calls to expand the powers of after crypto-related crime, would only offer one set of rules that might prove too restrictive for some digital asset businesses. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Foster likened trying to force digital assets into one box to a crowbar in an interview with the Telegraph: <\/span><\/p>\n<blockquote>\n<p class=\"p1\"><span class=\"s1\">\u201cIf you crowbar everything into the Regulated Activities Order you are making everything into an investment bank.\u201d<\/span><\/p>\n<\/blockquote>\n<h2>UK\u00a0Could Be At A Tipping Point<\/h2>\n<p class=\"p1\"><span class=\"s1\">The UK is at a crossroads with cryptocurrencies, and it has to be careful of how it proceeds, experts warn. On the one hand, the UK is <a href=\"https:\/\/cryptoslate.com\/report-united-kingdom-primed-to-lead-crypto-economy\/\"><span class=\"s2\">poised to become another crypto hub<\/span><\/a>, with a strong reputation as one of the world\u2019s financial centers already in place. Companies like Ripple are in agreement that the space does need some degree of regulation to prevent money laundering and fraud, and are willing to work with governments to <a href=\"https:\/\/cryptoslate.com\/ripple-uk-regulators\/\"><span class=\"s2\">make that happen<\/span><\/a>. <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">For its part, the FCA has stated it will commit to establishing \u201cperimeter guidance\u201d on which digital assets do and don\u2019t fall within its rules by the end of 2018, and whether that guidance will be extended to include more.
