{"id":90420,"date":"2018-10-24T00:00:52","date_gmt":"2018-10-24T07:00:52","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=90420"},"modified":"2019-10-23T17:06:45","modified_gmt":"2019-10-23T17:06:45","slug":"spain-approves-bill-requiring-crypto-holders-to-disclose-assets","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/spain-approves-bill-requiring-crypto-holders-to-disclose-assets\/","title":{"rendered":"Spain Approves Bill Requiring Crypto Holders to Disclose Assets"},"content":{"rendered":"<p class=\"p1\"><span class=\"s1\">On Oct. 19, Spain\u2019s Ministry of Finance <a href=\"https:\/\/www.abc.es\/economia\/abci-hacienda-obligara-declarar-todas-operaciones-bitcoin-y-criptomonedas-201810191412_noticia.html\"><span class=\"s2\">approved an anti-fraud law<\/span><\/a> requiring all holders of cryptocurrency in the country to disclose their asset balances, according to Spanish news outlet ABC. <\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Spain introduces law to force investors to reveal crypto holdings <a href=\"https:\/\/twitter.com\/hashtag\/cryptocurrency?src=hash&ref_src=twsrc%5Etfw\">#cryptocurrency<\/a> <a href=\"https:\/\/twitter.com\/hashtag\/news?src=hash&ref_src=twsrc%5Etfw\">#news<\/a> <a href=\"https:\/\/t.co\/5Q4Iy0GD9a\">https:\/\/t.co\/5Q4Iy0GD9a<\/a><\/p>\n<p>&mdash; Kris Tarr (@kris_tarr) <a href=\"https:\/\/twitter.com\/kris_tarr\/status\/1054525957304999938?ref_src=twsrc%5Etfw\">October 23, 2018<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<h2 class=\"p1\"><span class=\"s1\">Mandatory Reporting of Crypto<\/span><\/h2>\n<p class=\"p1\"><span class=\"s1\">Minister of Finance Mar\u00eda Jes\u00fas Montero stated at a press conference regarding the new law that it will require \u201cthe identification of the holders and the balances contributed by these virtual<span class=\"Apple-converted-space\">\u00a0 <\/span>currencies,\u201d adding, \u201cIt is stated as mandatory that people and companies inform the Tax Agency about this operation.\u201d <\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Spain\u2019s General Directorate on Taxation currently states that profits derived from cryptocurrency transactions are taxable as income tax, but transactions with bitcoins specifically are exempt from value-added tax.<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Residents of Spain with crypto holdings stored abroad will also have to report them in an annual declaration of goods abroad filing on their 720 tax form if the new law passes. New tax amnesties will be prohibited. <\/span><\/p>\n<h2 class=\"p1\"><span class=\"s1\">Spain, EU Slowly Adopting Digital Assets<\/span><\/h2>\n<p class=\"p1\"><span class=\"s1\">Currently,\u00a0Spain doesn\u2019t appear to regulate cryptocurrencies, having issued a statement in February of this year that cryptos are not considered legal tender and therefore not subject to any of the regulations or backed by any of the protections of conventional banking institutions. At the same time, Spain\u2019s Prime Minister Mariano Rajoy has <a href=\"https:\/\/hardwareate.com\/espana-busca-aprobar-una-legislacion-amistosas-las-criptomonedas\"><span class=\"s2\">expressed an interest<\/span><\/a> in crypto-friendly tax break legislation for businesses. <\/span><\/p>\n<figure id=\"attachment_87049\" aria-describedby=\"caption-attachment-87049\" style=\"width: 300px\" class=\"wp-caption alignright\"><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-87049\" src=\"https:\/\/cryptoslate.com\/wp-content\/uploads\/2018\/10\/spain-santander-ripple-payments-social-300x158.jpg\" alt=\"Spain\u2019s Banco Santander Takes a Liking to Ripple\u2019s Cross-Border Payments Solution\" width=\"300\" height=\"158\" \/><figcaption id=\"caption-attachment-87049\" class=\"wp-caption-text\">Related:\u00a0<a href=\"https:\/\/cryptoslate.com\/spains-banco-santander-takes-a-liking-to-ripples-xrp-cross-border-payments-solution\/\">Spain\u2019s Banco Santander Takes a Liking to Ripple\u2019s Cross-Border Payments Solution<\/a><\/figcaption><\/figure>\n<p class=\"p1\"><span class=\"s1\">Spain's Banco Santander, the largest financial institution in Europe, also <a href=\"https:\/\/cryptoslate.com\/spains-banco-santander-takes-a-liking-to-ripples-xrp-cross-border-payments-solution\/\"><span class=\"s2\">took part in testing of Ripple Labs\u2019 XRapid product<\/span><\/a> for cross-border transactions earlier this month, using it to launch their One PayFX cross-border payment service. Over 100 coffee shops in Spain now accept cryptocurrency as payment.\u00a0<\/span><\/p>\n<p class=\"p1\"><span class=\"s1\">Other EU countries like Malta and Portugal already have a framework for taxing cryptocurrencies in place, and <a href=\"https:\/\/www.loc.gov\/law\/help\/cryptocurrency\/world-survey.php#malta\"><span class=\"s2\">Malta<\/span><\/a>, in particular, has become a major blockchain hub. Overall, this seems to indicate that the EU is slowly but surely moving toward the acceptance of digital assets as a legitimate form of currency.
