{"id":72342,"date":"2018-08-02T22:00:22","date_gmt":"2018-08-03T05:00:22","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=72342"},"modified":"2019-11-07T02:54:30","modified_gmt":"2019-11-07T02:54:30","slug":"sec-commissioner-no-reason-not-to-allow-bitcoin-etf","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/sec-commissioner-no-reason-not-to-allow-bitcoin-etf\/","title":{"rendered":"SEC Commissioner: &#8216;No Reason&#8217; Not to Allow Bitcoin ETF"},"content":{"rendered":"<p>US SEC Commissioner Heston Peirce \u2014 one of the four <a href=\"http:\/\/cryptoslate.com\/tag\/sec\">SEC<\/a> commissioners currently considering the future of a potential <a href=\"https:\/\/cryptoslate.com\/interview-bitcoin-etf-approval-unlikely-in-2018-but-maybe-2019\/\">Bitcoin ETF<\/a> \u2014 publicly announced that there is \u201cno reason\u201d why the regulatory body would not allow the product to be approved<\/p>\n<p>Peirce, who recently published an <a href=\"https:\/\/cryptoslate.com\/sec-denies-winklevoss-bitcoin-etf-sec-commissioner-officially-dissents-with-ruling\/\">official statement of dissent<\/a> regarding the recent SEC rejection of the Winklevoss Bitcoin ETF, \u00a0outlined her stance on the future of cryptocurrency exchange-traded funds in an <a href=\"https:\/\/www.youtube.com\/watch?time_continue=1223&v=5sK5Z77FMyM\">interview<\/a> with CNBC\u2019s Cryptotrader host <a href=\"https:\/\/cryptoslate.com\/people\/ran-neuner\/\">r<\/a>.<\/p>\n<h2>SEC Has \u201cNo Jurisdiction\u201d to Assess Underlying Assets<\/h2>\n<p>Commissioner Peirce explained the reasoning behind the SEC\u2019s decision regarding the Winklevoss ETF in the CNBC interview, stating that the ETF rejection was the result of a 3-1 vote against approval and providing insight into the decision making<\/p>\n<blockquote><p>\u201cIf you read (the SEC\u2019s order) which is relatively long, they go through an analysis and say that the rule change \u2014 which is how this is done, an exchange comes in and they say \u2018we have a rule change that we would like to put into place that would allow us to trade this product\u2019 \u2014 and so the majority of the Commission said that the proposed change was actually not consistent with the governing statute \u2014 in this case, that\u2019s the Securities and Exchange Act.\u201d<\/p><\/blockquote>\n<p>Peirce, however, maintains that the Winklevoss ETF is in accordance with the Securities and Exchange act, stating that she would have let it go forward. The primary concerns expressed by the rest of the Commission, states Peirce, are with the nature of the Bitcoin market itself \u2014 which Peirce states is an example of the SEC reaching beyond its role as a regulatory body.<\/p>\n<blockquote><p>\u201cSpecifically in this case what I think (the SEC) did was look through to the underlying asset \u2014 in this case, that would be Bitcoin \u2014 ad they raised some concerns about the market for that underlying product \u2026 we should have really focused on the market where the exchange-traded product would trade as opposed to focusing on the underlying Bitcoin market.\u201d<\/p><\/blockquote>\n<p>Peirce highlights the manner in which the SEC handles gold and oil markets, pointing out that the SEC does not scrutinize the underlying assets that drive such markets when assessing complex financial products:<\/p>\n<blockquote><p>\u201cIt\u2019s not within our purview to go and look at how those markets are actually working, we should be focused on the market that\u2019s trading the security, which in this case would be the exchange-traded product.\u201d<\/p><\/blockquote>\n<h2>SEC Commissioner Retains Pro-ETF Stance<\/h2>\n<p>Discussing the upcoming VanEck Bitcoin ETF decision, Peirce emphasized the need for the SEC to increase the number of opportunities available to investors that allow them to participate in markers in a manner that is efficient and effective. While Peirce states that she does not hold any cryptocurrency in order to avoid any conflict of interest, she does see a significant promise in blockchain technology:<\/p>\n<blockquote><p>\u201cSo I don\u2019t (hold Bitcoin). But, I\u2019m a big fan of innovation and I think that there\u2019s a lot of interesting momentum in this space to solve problems that have been around for a long time \u2026 that can be solved by Bitcoin, cryptocurrencies and blockchain.\u201d<\/p><\/blockquote>\n<p>The future of the VanEck ETF, states Pierce, is positive.
