{"id":487263,"date":"2025-06-27T23:33:21","date_gmt":"2025-06-27T22:33:21","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=487263"},"modified":"2025-06-27T23:33:21","modified_gmt":"2025-06-27T22:33:21","slug":"ripple-sec-agree-to-mutually-abandon-appeals-ending-5-year-legal-battle","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/ripple-sec-agree-to-mutually-abandon-appeals-ending-5-year-legal-battle\/","title":{"rendered":"Ripple, SEC agree to mutually abandon appeals, ending 5-year legal battle"},"content":{"rendered":"<p><a href=\"https:\/\/cryptoslate.com\/companies\/ripple\/\">Ripple<\/a> will drop its cross-appeal in its prolonged legal battle with the U.S. Securities and Exchange Commission, signaling an end to one of the crypto industry\u2019s most consequential court cases.<\/p>\n<p>Ripple CEO <a href=\"https:\/\/cryptoslate.com\/people\/brad-garlinghouse\/\">Brad Garlinghouse<\/a> announced the move on <a href=\"https:\/\/x.com\/bgarlinghouse\/status\/1938705285323125151?s=46\">social media<\/a> on June 27 and also revealed that the SEC is expected to drop its appeal as well.<\/p>\n<p>He wrote:<\/p>\n<blockquote><p>&#8220;We\u2019re closing this chapter once and for all, and focusing on what\u2019s most important \u2013 building the Internet of Value.&#8221;<\/p><\/blockquote>\n<p>The decision follows Judge Analisa Torres\u2019 <a href=\"https:\/\/cryptoslate.com\/us-judge-denies-sec-and-ripples-second-bid-to-amend-penalty\/\">denial of a joint motion<\/a> for an indicative ruling earlier this week, marking the second time she <a href=\"https:\/\/cryptoslate.com\/court-denies-sec-ripple-settlement-motion-after-finding-procedural-misstep\/\">dismissed the appeal<\/a>.<\/p>\n<p>Ripple\u2019s chief legal officer, Stuart Alderoty, explained that the court's proffered options were to either dismiss its appeal challenging the prior finding on historic institutional sales of <a href=\"https:\/\/cryptoslate.com\/coins\/xrp\/\">XRP<\/a> or proceed with the appeal and continue litigation.<\/p>\n<p>The SEC sued Ripple in December 2020, alleging it conducted an unregistered securities offering by selling XRP tokens to institutional investors. In July 2023, Judge Torres ruled that while XRP itself is not a security and secondary market sales do not violate securities laws, Ripple\u2019s direct sales to institutional investors did constitute unregistered securities offerings.<\/p>\n<p>The ruling was considered a landmark split decision, with Ripple securing a major victory for the industry in clarifying that programmatic sales and secondary market trading of XRP do not fall under SEC jurisdiction. However, the finding on institutional sales posed potential financial penalties for Ripple.<\/p>\n<p>The SEC initially signaled an intent to appeal the ruling on XRP\u2019s non-security status but later indicated it would drop that appeal. Ripple\u2019s decision to abandon its <a href=\"https:\/\/cryptoslate.com\/sec-ripple-seek-to-end-multi-year-legal-dispute-with-amended-filing\/\">cross-appeal<\/a> effectively ends the litigation over the institutional sales ruling, avoiding further legal expenses and uncertainty.<\/p>\n<p>The outcome preserves XRP\u2019s legal clarity in the U.S. market while finalizing the company\u2019s settlement exposure. Ripple is expected to pay a civil penalty related to institutional sales, though the final amount is yet to be determined.<\/p>\n<p>With both appeals set to be withdrawn, the case closes a chapter that has defined crypto\u2019s regulatory landscape for nearly five years.
