{"id":485039,"date":"2025-06-13T10:50:56","date_gmt":"2025-06-13T09:50:56","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=485039"},"modified":"2025-06-13T10:50:56","modified_gmt":"2025-06-13T09:50:56","slug":"sec-pulls-back-from-crypto-rules-proposed-under-gary-gensler-administration","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/sec-pulls-back-from-crypto-rules-proposed-under-gary-gensler-administration\/","title":{"rendered":"SEC pulls back from crypto rules proposed under Gary Gensler administration"},"content":{"rendered":"<p>The US Securities and Exchange Commission (SEC) is rolling back 14 proposed rules, including key measures that once targeted the crypto industry.<\/p>\n<p>The decision, <a href=\"https:\/\/www.sec.gov\/rules-regulations\/rulemaking-activity?rulemaking_status=177456\">announced<\/a> on June 12, illustrates the shift in regulatory priorities as the agency distances itself from the aggressive stance adopted during the previous administration.<\/p>\n<p data-start=\"684\" data-end=\"987\">The withdrawn proposals were introduced between March 2022 and November 2023 under former SEC Chair <a href=\"https:\/\/cryptoslate.com\/people\/gary-gensler\/\">Gary Gensler<\/a> and had drawn sharp opposition from crypto advocates.<\/p>\n<h2>SEC rescinded rules<\/h2>\n<p data-start=\"1311\" data-end=\"1425\">Two of the rescinded rules would have directly impacted how digital assets are managed and traded in the US.<\/p>\n<p data-start=\"1427\" data-end=\"1676\">One rule sought to expand the definition of securities exchanges to cover DeFi platforms. The proposal would have brought a wide range of blockchain-based systems under the SEC\u2019s jurisdiction by classifying them as exchanges.<\/p>\n<p data-start=\"1678\" data-end=\"2042\">Another of these rescinded rules targeted crypto custody practice.<\/p>\n<p data-start=\"1678\" data-end=\"2042\">The proposal required investment advisers to store all client assets, including digital assets, with qualified custodians.<\/p>\n<p data-start=\"1678\" data-end=\"2042\">Under this framework, many established crypto custodians would have failed to meet the SEC\u2019s stricter criteria, leaving only banks and broker-dealers eligible to safeguard assets.<\/p>\n<p data-start=\"1678\" data-end=\"2042\">Eleano Terret, former Fox Business journalist, <a href=\"https:\/\/x.com\/EleanorTerrett\/status\/1933315209034158511\">said<\/a>:<\/p>\n<blockquote>\n<p data-start=\"1678\" data-end=\"2042\">&#8220;The Custody Rule aimed to cover all client assets including crypto, broadened what counts as &#8216;custody,' and raised concerns about whether certain state chartered entities should be qualified custodians.&#8221;<\/p>\n<\/blockquote>\n<p data-start=\"684\" data-end=\"987\">At the time, critics argued that these rules would have imposed undue restrictions on the sector, stifling innovation and driving activity offshore.<\/p>\n<h2>Pro-crypto moves<\/h2>\n<p data-start=\"2075\" data-end=\"2346\">The SEC\u2019s decision to abandon these proposals is part of a broader <a href=\"https:\/\/cryptoslate.com\/secs-next-crypto-roundtable-to-host-defi-dialogue-addressing-autonomy-in-regulation\/\">effort to clarify crypto regulation<\/a>.<\/p>\n<p data-start=\"2075\" data-end=\"2346\">It also aligns with President <a href=\"https:\/\/cryptoslate.com\/people\/donald-trump\/\">Donald Trump's<\/a> deregulatory push to reduce compliance burdens in both traditional and digital markets.<\/p>\n<p data-start=\"2348\" data-end=\"2636\">In recent months, the SEC has <a href=\"https:\/\/cryptoslate.com\/sec-ripple-seek-to-end-multi-year-legal-dispute-with-amended-filing\/\">dropped several lawsuits<\/a> against crypto companies, signaling a retreat from the previous regulation-by-enforcement approach.<\/p>\n<p data-start=\"2348\" data-end=\"2636\"><span style=\"margin: 0px; padding: 0px;\">At the same time, the financial regulator's new Chair, <a href=\"https:\/\/cryptoslate.com\/people\/paul-atkins\/\">Paul Atkins<\/a>, has made concrete\u00a0<a href=\"https:\/\/cryptoslate.com\/sec-chair-paul-atkins-backs-defi-rejects-forced-intermediaries-during-latest-roundtable-speech\/\" target=\"_blank\" rel=\"noopener\">efforts to introduce pro-crypto regulations<\/a>, which are expected to foster responsible innovation in the sector.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The US Securities and Exchange Commission (SEC) is rolling back 14 proposed rules, including key measures that once targeted the crypto industry.
