First, the US Securities and Exchange Commission (SEC) confirmed on May 29 that<\/span> <strong><a href=\"https:\/\/cryptoslate.com\/sec-removes-key-hurdle-for-ethereum-etfs-by-exempting-staking-from-securities-rules\/\">staking does not constitute a securities sale<\/a><\/strong><span style=\"font-weight: 400;\">, provided customers keep ownership of their assets and receive risk disclosures.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This understanding applies to solo, delegated, or carried out through a custodial service staking.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Second, the bipartisan Digital Asset Market Clarity Act (CLARITY Act) would<\/span> <strong><a href=\"https:\/\/cryptoslate.com\/bipartisan-lawmakers-roll-out-clarity-act-shift-crypto-spot-rule-to-cftc\/\">shift the oversight of most secondary market token trading<\/a><\/strong><span style=\"font-weight: 400;\"> to the Commodity Futures Trading Commission (CFTC) while leaving initial fundraising events under the jurisdiction of the SEC.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The CLARITY Act is also a recent move in the US crypto industry, filed on the same day as the SEC shared its statement on staking.<\/span><\/p>\n<p>However, no ETF offering staking has received regulatory approval as of June 4.<\/p>\n<p><span style=\"font-weight: 400;\">Nansen argues that the twin actions remove a structural barrier for issuers planning products that wrap staking rewards inside an ETF chassis.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The note named <a href=\"https:\/\/cryptoslate.com\/companies\/blackrock\/\">BlackRock<\/a>, <a href=\"https:\/\/cryptoslate.com\/companies\/fidelity-investments\/\">Fidelity<\/a>, and <a href=\"https:\/\/cryptoslate.com\/companies\/bitwise\/\">Bitwise<\/a> as manufacturers preparing to capitalize on the change alongside significant staking assets such as Ethereum (<a href=\"https:\/\/cryptoslate.com\/coins\/ethereum\/\">ETH<\/a>), Solana (<a href=\"https:\/\/cryptoslate.com\/coins\/solana\/\">SOL<\/a>), and <a href=\"https:\/\/cryptoslate.com\/coins\/bnb\/\">BNB<\/a>, as well as liquid staking protocols like <a href=\"https:\/\/cryptoslate.com\/products\/lido\/\">LIDO<\/a>.<\/span><\/p>\n<h2><strong>Yield-bearing structures<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">The report also mapped two macro paths tied to US-China trade talks that could add fuel to boost ETFs offering to stake.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Under the base case scenario, which assumes talks \u201cmuddle through\u201d and the Senate softens a pending tax provision, Bitcoin (<a href=\"https:\/\/cryptoslate.com\/coins\/bitcoin\/\">BTC<\/a>) retests its record. At the same time, staked currencies receive an extra boost from regulatory momentum.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In the bearish scenario, a tariff re-escalation pressures equities first. Yet, the report still shared expectations that staked tokens and related ETFs would outpace stocks because their yield component would offset price weakness.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Data from DefiLlama<\/span> <strong><a href=\"https:\/\/defillama.com\/yields?category=Liquid+Staking&category=Staking+Pool&token=ETH&token=SOL\">reveals that ETH<\/a><\/strong><span style=\"font-weight: 400;\"> staking and liquid staking yields range between 2.5% and 3% on the largest platforms by total value locked (TVL).
