However, the exchange has <a href=\"https:\/\/cryptoslate.com\/coinbase-scores-legal-win-court-orders-sec-to-explain-lack-of-crypto-rulemaking\/\">contested these claims<\/a>, asserting that the agency's regulations are ill-suited for the unique characteristics of digital assets.<\/p>\n<p>The case has emerged as a landmark moment in determining how cryptocurrencies are governed under US law.\u00a0Lummis' brief contends that the SEC has inconsistently applied the Howey Test, a legal framework for defining securities, creating regulatory uncertainty for businesses and consumers.<\/p>\n<p>She emphasized that such interpretations are better left to Congress, which can craft laws that balance innovation with consumer protection.<\/p>\n<h2>Changing guard<\/h2>\n<p>The filing comes as the SEC undergoes leadership changes under the <a href=\"https:\/\/cryptoslate.com\/people\/donald-trump\/\">Trump<\/a> administration, with Acting Chair <a href=\"https:\/\/cryptoslate.com\/people\/mark-uyeda\/\">Mark Uyeda<\/a> signaling a shift in priorities.\u00a0Uyeda recently announced the formation of a crypto task force to create a more pragmatic regulatory framework.<\/p>\n<p>This development has <a href=\"https:\/\/cryptoslate.com\/mark-uyeda-appointed-acting-sec-chair-ahead-of-atkins-2026-succession-gensler-officially-resigns\/\">fueled optimism among crypto advocates<\/a> that the agency may adopt a less adversarial stance. Lummis, who now leads the Senate Banking Committee's <a href=\"https:\/\/cryptoslate.com\/cynthia-lummis-nominated-to-lead-new-senate-banking-subcommittee-on-digital-assets\/\">digital assets panel<\/a>, has long championed bipartisan efforts to clarify regulatory oversight for crypto.<\/p>\n<p>She co-authored legislation with Senator Kirsten Gillibrand (D-N.Y.) proposing a clearer division of responsibilities between the SEC and the Commodity Futures Trading Commission (CFTC).\u00a0The bill also aims to streamline compliance requirements for crypto platforms, providing much-needed clarity for the industry.<\/p>\n<p>With the Coinbase case now before the Second Circuit, Lummis has urged the court to curb the SEC's enforcement-led approach.
