He<\/span><span style=\"font-weight: 400;\">\u00a0faces nine charges, including wire, securities, and commodities fraud, stemming from his alleged role in Terraform Labs' collapse after the price of its tokens, <a href=\"https:\/\/cryptoslate.com\/coins\/terra-classic\/\">LUNA<\/a> and UST, crashed.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">After being arrested in Montenegro in March 2023 while attempting to travel on a fake passport, Kwon remained in the country during a tug-of-war between US and South Korean authorities over where he would face charges.\u00a0<\/span><span style=\"font-weight: 400;\">Both nations had accused Kwon of fraud, with South Korea seeking extradition due to his citizenship.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Meanwhile, Kwon appealed to avoid extradition to the US, as financial crime penalties in South Korea are generally less severe.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Montenegro's Constitutional Court <\/span><strong><a href=\"https:\/\/cryptoslate.com\/montenegro-court-rejects-do-kwons-extradition-appeal\/\">rejected the appeal<\/a><\/strong><span style=\"font-weight: 400;\"> on Dec. 26 and the country's Justice Minister subsequently <\/span><strong><a href=\"https:\/\/cryptoslate.com\/montenegros-justice-minister-signs-order-to-extradite-do-kwon-to-us\/\">signed an order<\/a><\/strong><span style=\"font-weight: 400;\"> to extradite the Terraform Labs co-founder a few days later.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">On Dec. 31, the Montenegrin police <\/span><strong><a href=\"https:\/\/cryptoslate.com\/us-authorities-take-custody-of-do-kwon-ending-months-long-extradition-process\/\">transferred Kwon<\/a><\/strong><span style=\"font-weight: 400;\"> to US authorities at the Podgorica International Airport.<\/span><\/p>\n<h2><strong>Awaiting trial<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">Prosecutors in New York allege Kwon misled investors about the Terra blockchain\u2019s capabilities and adoption rates, claiming his actions directly contributed to the platform's catastrophic collapse.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Manhattan US Attorney's Office, which successfully prosecuted <a href=\"https:\/\/cryptoslate.com\/companies\/ftx\/\">FTX<\/a> co-founder <a href=\"https:\/\/cryptoslate.com\/people\/sam-bankman-fried\/\">Sam Bankman-Fried<\/a> last year, is leading the case against Kwon.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Moreover, Kwon is already facing legal consequences. A US jury found him and Terraform Labs liable in a civil fraud case brought by the Securities and Exchange Commission (SEC), resulting<\/span> <strong><a href=\"https:\/\/cryptoslate.com\/us-court-issues-final-judgement-against-terraform-labs-do-kwon-imposes-4-5-billion-in-fines\/\">in a $4.47 billion settlement<\/a><\/strong><span style=\"font-weight: 400;\">. Terraform subsequently filed for bankruptcy.\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Kwon's attorney declined to comment after the hearing.
