{"id":435512,"date":"2024-07-30T11:00:18","date_gmt":"2024-07-30T10:00:18","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=435512"},"modified":"2024-07-30T12:33:38","modified_gmt":"2024-07-30T11:33:38","slug":"sec-seeks-to-amend-binance-lawsuit-to-avoid-ruling-on-sol-security-status","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/sec-seeks-to-amend-binance-lawsuit-to-avoid-ruling-on-sol-security-status\/","title":{"rendered":"SEC seeks to amend Binance lawsuit to avoid ruling on SOL&#8217;s security status"},"content":{"rendered":"<p>The US Securities and Exchange Commission (SEC) is seeking to modify its ongoing lawsuit against <a href=\"https:\/\/cryptoslate.com\/companies\/binance\/\">Binance<\/a> to avoid a court decision on the security status of third-party tokens like Solana.<\/p>\n<p>In a joint July 29 court <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.256060\/gov.uscourts.dcd.256060.253.0.pdf\">filing<\/a>, the SEC requested permission to amend its original complaint against the crypto trading platform, stating that it aims to avoid a court ruling on the &#8220;Third Party Crypto Asset Securities&#8221; referenced in the case.<\/p>\n<p>The proposed amendment seeks to defer any court ruling on these tokens' security status. If granted, it would effectively remove the SEC from classifying these assets as securities, but they would remain subject to regulatory uncertainty regarding their legal status.<\/p>\n<p>Third-party coins are digital assets issued by entities other than Binance that were listed on its platform. Last year, the SEC accused Binance of breaching federal securities laws by listing native tokens of <a href=\"https:\/\/cryptoslate.com\/coins\/solana\/\">Solana<\/a>, Cardano, Polygon, Cosmos, Filecoin, and <a href=\"https:\/\/cryptoslate.com\/coins\/algorand\/\">Algorand<\/a>, arguing that these tokens met the Howey Test criteria for securities.<\/p>\n<p>However, the SEC's case encountered a setback last month when a US federal court <a href=\"https:\/\/cryptoslate.com\/judge-dismisses-counts-related-to-busd-bnb-sales-in-sec-binance-lawsuit\/\">ruled<\/a> that the secondary sales of digital assets like the <a href=\"https:\/\/cryptoslate.com\/coins\/bnb\/\">BNB<\/a> token do not qualify as securities.<\/p>\n<p>Meanwhile, crypto community members on social media have interpreted the SEC's filing as further indications that digital assets like SOL and ADA do not qualify as securities and are unfairly targeted by the financial watchdog's <a href=\"https:\/\/cryptoslate.com\/sec-uses-insider-trading-judgment-to-enhance-case-against-coinbase-binance-us\/\">regulation-by-enforcement approach<\/a>.<\/p>\n<h2>Binance's response to the SEC<\/h2>\n<p>In response, Binance stated it would not agree to begin discovery until it had reviewed the SEC's proposed amended complaint.
