{"id":419879,"date":"2024-05-17T21:54:01","date_gmt":"2024-05-17T20:54:01","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=419879"},"modified":"2024-05-17T21:54:01","modified_gmt":"2024-05-17T20:54:01","slug":"warren-expresses-support-for-secs-controversial-sab-121-bulletin","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/warren-expresses-support-for-secs-controversial-sab-121-bulletin\/","title":{"rendered":"Warren expresses support for SEC&#8217;s controversial SAB 121 bulletin"},"content":{"rendered":"<p>Senator <a href=\"https:\/\/cryptoslate.com\/people\/elizabeth-warren\/\">Elizabeth Warren<\/a> described support for the SEC's Staff Accounting Bulletin (SAB) 121 during a senate hearing on May 16.<\/p>\n<p>Warren asserted that the bulletin, which applies to companies that deal with crypto, is designed to provide accounting guidance.<\/p>\n<p>She said that SAB 121 &#8220;simply clarifies&#8221; how companies should account for risks related to crypto and make such risks visible in their disclosures. Relevant risks include hacks, theft, and the loss of crypto when a safeguarding company enters bankruptcy.<\/p>\n<p>She said:<\/p>\n<blockquote><p>&#8220;The vote today is about ensuring that the SEC is able to issue guidance that will help companies &#8230;. produce strong, consistent, timely and meaningful accounting disclosures&#8221;<\/p><\/blockquote>\n<p>Warren asserted that the bulletin does not require crypto platforms to add customers' crypto to their balance sheet \u2014 a statement at odds with <span class=\"middlecopy\"> House Financial Services Committee Chairman <\/span> <a href=\"https:\/\/cryptoslate.com\/people\/patrick-mchenry\/\">Patrick McHenry<\/a>, who previously <a href=\"https:\/\/financialservices.house.gov\/news\/documentsingle.aspx?DocumentID=409247\">said that the bill<\/a> &#8220;<span class=\"middlecopy\">requires financial institutions and firms that are safeguarding their customers' digital assets to hold those assets on their balance sheet.<\/span>&#8221;<\/p>\n<p>Warren added that the bulletin does not make a platform the owner of its customers' crypto.<\/p>\n<h2>Warren opposed vote<\/h2>\n<p>Warren made her comments before a senate vote on HJ Res. 109, which had the potential to overturn the bulletin. She opposed the vote itself, stating:<\/p>\n<blockquote><p>&#8220;<span class=\"cursor-pointer group\" title=\"Play starting at 1:26\"><span class=\"group-hover:bg-base-200 rounded p-0.5 -m-0.5\" data-start=\"85830\" data-end=\"92130\"> We should not be holding this vote, and all by<\/span><\/span><span class=\"cursor-pointer group\" title=\"Play starting at 1:32\"><span class=\"group-hover:bg-base-200 rounded p-0.5 -m-0.5\" data-start=\"92130\" data-end=\"97270\">itself that is a good enough reason to vote no.<\/span><\/span><\/p><\/blockquote>\n<p>Warren stated that because the SEC published its bulletin more than two years ago, the current vote falls outside the time limit for congressional review.<\/p>\n<p>Warren also asserted that the matter is &#8220;far outside the scope&#8221; of the Congressional Review Act (CRA) because the bulletin is not a notice and comment rule. She said the CRA does not apply to staff bulletins and that such bulletins do not even have the force of law.<\/p>\n<p>Contrary to Warren, the US Government Accountability Office (GAO) <a href=\"https:\/\/www.gao.gov\/products\/b-334540\">determined<\/a> SAB 121 to be a rule for the purposes of the CRA in October 2023.<\/p>\n<h2>Presidential veto expected<\/h2>\n<p>A significant majority of the Senate voted to overturn SAB 121 on <a href=\"https:\/\/cryptoslate.com\/us-lawmakers-vote-in-favor-of-repealing-controversial-sec-accounting-rules-for-crypto\/\">May 16<\/a> after the House of Representatives voted to advance HJ Res. 109 on <a href=\"https:\/\/cryptoslate.com\/biden-administration-to-veto-overturning-of-sec-crypto-rule-sab-121\/\">May 8<\/a>.<\/p>\n<p>President <a href=\"https:\/\/cryptoslate.com\/people\/joe-biden\/\">Joe Biden<\/a> intends to veto the resolution. The Senate vote did not produce a significant enough majority to prevent the presidential veto.<\/p>\n<p>Biden must veto the bill within 10 days of it reaching his desk.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Senator Elizabeth Warren described support for the SEC&#8217;s Staff Accounting Bulletin (SAB) 121 during a senate hearing on May 16.
