{"id":383193,"date":"2023-12-19T15:40:01","date_gmt":"2023-12-19T15:40:01","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=383193"},"modified":"2023-12-19T15:40:27","modified_gmt":"2023-12-19T15:40:27","slug":"montenegrin-appeals-court-overturns-do-kwon-extradition-decision","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/montenegrin-appeals-court-overturns-do-kwon-extradition-decision\/","title":{"rendered":"Montenegrin appeals court overturns Do Kwon extradition decision"},"content":{"rendered":"<p>The Montenegro Court of Appeal has overturned the Podgorica High Court's decision to extradite <a href=\"https:\/\/cryptoslate.com\/people\/do-kwon\/\">Do Kwon<\/a>, co-founder of <a href=\"https:\/\/cryptoslate.com\/companies\/terraform-labs\/\">Terraform Labs<\/a>, following his appeal, according to a Dec. 19 <a href=\"https:\/\/sudovi.me\/ascg\/sadrzaj\/nm4D\">update<\/a> on the court website.<\/p>\n<p>Initially, the Podgorica High Court had <a href=\"https:\/\/cryptoslate.com\/montenegro-court-clears-path-for-do-kwons-extradition-to-us-or-south-korea\/\">greenlit<\/a> Kwon\u2019s extradition to either the U.S. or South Korea in November, citing these countries' compliance with the legal criteria necessary for his extradition.<\/p>\n<p>However, Kwon expressed dissatisfaction and filed an appeal. Subsequently, the court of appeal voided the extradition order, returning the case to a lower court for a fresh trial.<\/p>\n<p>The recent ruling highlighted that the lower court's extradition order breached specific legal provisions. A translated version of the notice reads:<\/p>\n<blockquote><p>&#8220;<span lang=\"SR-LATN-RS\"><span class=\"\">The panel of the Appellate Court assessed that<\/span><\/span>\u00a0<span lang=\"EN-US\"><span class=\"\">that decision was affected by a significant violation of the provisions of criminal procedure from Article 386 paragraph 1 item 9 of the CPC, on which violation is reasonably indicated by the appeal of the defendant's defense attorneys, because the decision\u00a0<\/span><\/span><span lang=\"SR-LATN-ME\"><span class=\"\">does not have reasons for decisive facts, and the reasons given are unclear, which is the reason for its cancellation.&#8221;<\/span><\/span><\/p><\/blockquote>\n<p>Moreover, the appeal court criticized the lower court for disregarding Kwon's stance on extradition to the U.S.<\/p>\n<p>While uncertainty looms over where Kwon would be sent, the disgraced crypto tycoon has previously expressed preference to be extradited to South Korea. However, Montenegro's Minister of Justice reportedly <a href=\"https:\/\/cryptoslate.com\/do-kwon-to-be-extradited-to-the-u-s-to-face-criminal-charges-wsj\/\">leans towards<\/a> extraditing him to the U.S.<\/p>\n<p>These developments follow Kwon's arrest earlier this year in Montenegro for traveling with forged documents. He was subsequently <a href=\"https:\/\/cryptoslate.com\/terras-do-kwon-sentenced-to-4-months-imprisonment-in-montenegro\/\">imprisoned<\/a> for four months.<\/p>\n<p>Meanwhile, the U.S. and South Korea have both filed legal actions against Kwon for his alleged role in the collapse of Terra's algorithmic <a href=\"https:\/\/cryptoslate.com\/coins\/terrausd\/\">UST<\/a> stablecoin that wiped out more than $40 billion from the industry.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Montenegro Court of Appeal has overturned the Podgorica High Court&#8217;s decision to extradite Do Kwon, co-founder of Terraform Labs, following his appeal, according to a Dec. 19 update on the court website.
