{"id":363789,"date":"2023-10-10T23:05:49","date_gmt":"2023-10-10T22:05:49","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=363789"},"modified":"2023-10-10T23:05:48","modified_gmt":"2023-10-10T22:05:48","slug":"changpeng-zhao-and-other-binance-executives-facing-possible-indictments-in-brazil","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/changpeng-zhao-and-other-binance-executives-facing-possible-indictments-in-brazil\/","title":{"rendered":"Changpeng Zhao and other Binance executives facing possible indictments in Brazil"},"content":{"rendered":"<p>A Brazilian congressional committee has asked for Binance CEO <a href=\"https:\/\/cryptoslate.com\/people\/changpeng-zhao\/\">Changpeng Zhao<\/a> and three other company executives to be indicted, <em>Bloomberg<\/em> said on <a href=\"https:\/\/www.bnnbloomberg.ca\/binance-ceo-changpeng-zhao-other-exchange-leaders-at-risk-of-brazil-indictment-1.1982740\">Oct. 10<\/a>.<\/p>\n<p>Following the committee's recommendations, the decision to indict Zhao and the other company executives now lies with the Brazilian police.<\/p>\n<p>The committee alleged that Zhao and the other executives have engaged in fraudulent management, offering or trading of securities without previous authorization, and operation of a financial institution without authorization.<\/p>\n<p>The same congressional committee asked for Brazil's securities regulator, Comiss\u00e3o de Valores Mobili\u00e1rios (CVM), to investigate Binance's continued derivatives sales following an earlier stop order. Related investigations began in <a href=\"https:\/\/cryptoslate.com\/brazil-investigating-binance-over-illegal-derivatives-offerings\/\">April<\/a>.<\/p>\n<p><em>Bloomberg<\/em> noted that the CVM rejected a 2 million reais ($396,000) settlement that Binance proposed in August. It said Binance now faces further fines and penalties.<\/p>\n<h2>Binance responds to allegations<\/h2>\n<p>Binance responded to the report by stating that it has made extensive efforts to work with the Brazilian congressional committee. The company said:<\/p>\n<blockquote><p>&#8220;[Binance] strongly rejects any attempts to make [it] a target or even expose its users and employees with allegations of bad practices without any proof, amid competitive disputes given the company\u2019s leadership position in Brazil and in the world.&#8221;<\/p><\/blockquote>\n<p>Binance and its executives also face scrutiny from authorities outside of Brazil. In <a href=\"https:\/\/www.google.com\/url?sa=t&rct=j&q=&esrc=s&source=web&cd=&ved=2ahUKEwix_LnitOyBAxUsIjQIHbP-AL0QFnoECBAQAQ&url=https%3A%2F%2Fcryptoslate.com%2Fbinance-and-cz-sued-by-sec-for-breaching-securities-law%2F&usg=AOvVaw3V7HZFf8k8GiklU7c77puf&opi=89978449\">June<\/a>, the U.S. Securities and Exchange Commission (SEC) filed charges against Binance, Binance.US, Changpeng Zhao, and related parties over alleged violations of securities law. The <a href=\"https:\/\/cryptoslate.com\/cftc-sues-binance-over-alleged-breaking-of-trading-and-derivatives-rules\/\">Commodity Futures Trading Commission<\/a> (CFTC) has additionally charged Binance, while the <a href=\"https:\/\/cryptoslate.com\/u-s-department-of-justice-weighing-criminal-charges-against-binance-against-risk-of-market-panic-report\/\">Department of Justice<\/a> (DOJ) is reportedly weighing charges as well.<\/p>\n<p>Binance has also been under investigation by French authorities for more than a year, according to reports that emerged in <a href=\"https:\/\/cryptoslate.com\/french-authorities-have-been-investigating-binance-since-february-2022\/\">June 2023<\/a>.<\/p>\n<p>Furthermore, Binance has left several countries in anticipation of regulatory challenges, including <a href=\"https:\/\/www.bnnbloomberg.ca\/binance-exits-russia-with-sale-of-unit-to-just-started-exchange-1.1976907\">Russia<\/a>, <a href=\"https:\/\/cryptoslate.com\/binances-cz-opens-up-on-the-exchanges-canada-exit-hopes-to-return-one-day\/\">Canada<\/a>, <a href=\"https:\/\/cryptoslate.com\/here-is-why-binance-is-leaving-singapore\/\">Singapore<\/a>, and the <a href=\"https:\/\/cryptoslate.com\/binance-withdraws-from-netherlands-following-vasp-license-snub\/\">Netherlands<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Brazilian congressional committee has asked for Binance CEO Changpeng Zhao and three other company executives to be indicted, Bloomberg said on Oct. 10.
