{"id":349502,"date":"2023-08-11T22:08:23","date_gmt":"2023-08-11T21:08:23","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=349502"},"modified":"2023-08-12T01:22:53","modified_gmt":"2023-08-12T00:22:53","slug":"geminis-cameron-winklevoss-slams-dcg-for-denying-involvement-in-failed-earn-program","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/geminis-cameron-winklevoss-slams-dcg-for-denying-involvement-in-failed-earn-program\/","title":{"rendered":"Gemini&#8217;s Cameron Winklevoss slams DCG for denying involvement in failed Earn program"},"content":{"rendered":"<p>Gemini co-founder <a href=\"https:\/\/cryptoslate.com\/people\/cameron-winklevoss\/\">Cameron Winklevoss<\/a> criticized Digital Currency Group (DCG) on <a href=\"https:\/\/twitter.com\/cameron\/status\/1690049346803245056\">Aug. 11<\/a> as part of an ongoing dispute between the two firms.<\/p>\n<p>On Twitter, Winklevoss said:<\/p>\n<blockquote><p>&#8220;[DCG's] response [to Gemini's lawsuit] &#8230; is filled with carefully crafted statements that are incredibly revealing &#8230; It completely ignores the reality of the situation in a comical way.&#8221;<\/p><\/blockquote>\n<p><a href=\"https:\/\/cryptoslate.com\/companies\/gemini\/\">Gemini<\/a> once offered its <a href=\"https:\/\/cryptoslate.com\/companies\/genesis\/\">Earn<\/a> product in partnership with Genesis, a subsidiary of DCG. Genesis halted withdrawals in November 2022 and later filed for bankruptcy; Gemini also <a href=\"https:\/\/cryptoslate.com\/breaking-gemini-earn-halts-withdrawals-due-to-market-turmoil-caused-by-ftx-fallout\/\">halted Earn withdrawals<\/a> in November as a result of the broader Genesis halt.<\/p>\n<p>Later, in July 2023, Gemini <a href=\"https:\/\/cryptoslate.com\/gemini-sues-dcg-barry-silbert-over-alleged-fraud-related-to-genesis\/\">filed a lawsuit<\/a> against DCG and its CEO <a href=\"https:\/\/cryptoslate.com\/people\/barry-silbert\/\">Barry Silbert<\/a> alleging that the Earn offer was built on fraud and deception. On Aug. 10, DCG <a href=\"https:\/\/cryptoslate.com\/dcg-labels-gemini-lawsuit-as-character-assassination-in-motion-to-dismiss\/\">filed a response<\/a> to Gemini in which it accused Gemini of attempting to avoid responsibility for the failure of Earn. DCG's latest filing also serves as a motion to dismiss Genesis' case.<\/p>\n<p>Now, Winklevoss has contested several statements within DCG's filing and motion to dismiss. On Aug. 11, Winklevoss highlighted DCG's claim that it &#8220;had virtually nothing to do with the Gemini Earn program.&#8221; DCG argued in its latest filing that it and other Genesis affiliates were excluded from liability under earlier agreements around Earn.<\/p>\n<p>Winklevoss argued that this denial \u2014 seemingly only a partial one \u2014 is in fact a &#8220;direct admission&#8221; that DCG played some role in the Gemini Earn program.<\/p>\n<h2>Gemini says DCG misrepresented $1.1B of finances<\/h2>\n<p>DCG also claimed that it had no duty to Gemini to correct statements that were made by its subsidiary, Genesis. Winklevoss contested that claim, writing:<\/p>\n<blockquote><p>&#8220;When a company you own [Genesis] says you [DCG] wrote a $1.1 billion dollar check that you know you didn\u2019t write, yes, you have a duty to correct this.&#8221;<\/p><\/blockquote>\n<p>That statement concerns the fact that DCG owes $1.1 billion to Genesis to cover Genesis' loan with the failed crypto firm <a href=\"https:\/\/cryptoslate.com\/companies\/three-arrows-capital\/\">Three Arrows Capital<\/a> (3AC). This issue in part led Genesis to freeze withdrawals in November, which in turn led to a halt of Gemini Earn. Much of Gemini's case revolves around the allegation that DCG did not accurately represent Genesis' financial situation, including the status of the above loan.<\/p>\n<p>Winklevoss concluded by alleging that DCG's legal defenses were created &#8220;in a vacuum&#8221; and accused the company of attempting to evade responsibility. He reiterated that the two companies will go to court over the issue.<\/p>\n<p>Gemini's ongoing lawsuit against DCG is just one part of legal proceedings involving the two firms. Genesis is also engaged with its <a href=\"https:\/\/cryptoslate.com\/genesis-trading-files-updated-reorganization-plan\/\">broader bankruptcy case<\/a>, where it owes over $3.5 billion to creditors including Gemini and FTX.<\/p>\n<p>The U.S. SEC also <a href=\"https:\/\/cryptoslate.com\/sec-charges-gemini-genesis-over-earn-program\/\">sued Gemini and Genesis<\/a> over the failed Earn product in January. As of <a href=\"https:\/\/cryptoslate.com\/gemini-and-genesis-seek-to-dismiss-sec-lawsuit-over-defunct-earn-product\/\">May<\/a>, both companies sought for those charges to be dismissed.
