{"id":339212,"date":"2023-07-01T01:02:00","date_gmt":"2023-07-01T00:02:00","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=339212"},"modified":"2023-07-01T01:02:00","modified_gmt":"2023-07-01T00:02:00","slug":"kraken-ordered-to-provide-irs-with-user-data","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/kraken-ordered-to-provide-irs-with-user-data\/","title":{"rendered":"Kraken ordered to provide IRS with user data"},"content":{"rendered":"<p><a href=\"https:\/\/cryptoslate.com\/companies\/kraken\/\">Kraken<\/a> has been ordered to provide information about its users to the Internal Revenue Service (IRS), according to a June 30 <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.cand.407965\/gov.uscourts.cand.407965.34.0.pdf\">court filing<\/a>.<\/p>\n<h2>Users who traded $20K affected<\/h2>\n<p>The filing says that Kraken must provide the IRS with identifying information about users that traded at least $20,000 worth of cryptocurrency over a one-year period. This applies to users who were active between Jan. 1, 2016 and Dec. 31, 2020.<\/p>\n<p>The court ruled that Kraken must share certain information such as user names, birth dates, tax numbers, addresses, and contact information.<\/p>\n<p>The court otherwise conceded to Kraken that the government made overly broad requests for information. Notably, it decided that the tax agency's requests for <a href=\"https:\/\/cryptoslate.com\/glossary\/kyc\/\">KYC\/AML<\/a> data and information on users' employment, net worth, and source of wealth were overbroad. As such, Kraken is not yet required to provide that data to the IRS.<\/p>\n<p>In addition to providing user information, Kraken must also provide certain on-chain information such as transaction hashes and blockchain addresses. The amount of blockchain data that Kraken must provide accounts for &#8220;chainsplitting&#8221; or <a href=\"https:\/\/cryptoslate.com\/glossary\/hard-fork\/\">hard forks<\/a>, which can affect user holdings but which are not fully observed in Kraken's records.<\/p>\n<p>Finally, Kraken must provide certain transactional records, namely those that were not found to be part of the government's overbroad requests.<\/p>\n<h2>IRS has sought Kraken data for years<\/h2>\n<p>The IRS has attempted to obtain Kraken's user records since at least <a href=\"https:\/\/www.justice.gov\/opa\/pr\/court-authorizes-service-john-doe-summons-seeking-identities-us-taxpayers-who-have-used-1\">May 2021<\/a>, when it was permitted to serve a summons to the exchange. The current case began in February 2023 after officials began an attempt to enforce the 2021 summons.<\/p>\n<p>The tax agency has previously obtained access to customer data from other crypto platforms including <a href=\"https:\/\/cryptoslate.com\/court-says-irs-has-legal-authority-to-access-coinbase-users-trading-data\/\">Coinbase<\/a>, <a href=\"https:\/\/cryptoslate.com\/irs-gets-access-to-crypto-exchange-circles-user-data-targets-kraken-next\/\">Circle<\/a>, and <a href=\"https:\/\/www.justice.gov\/opa\/pr\/court-authorizes-service-john-doe-summons-seeking-identities-us-taxpayers-who-have-used-2\">SFOX<\/a>.<\/p>\n<p>Recent surveys suggest that the vast majority of crypto investors <a href=\"https:\/\/cryptoslate.com\/only-0-53-of-investors-declared-their-crypto-for-tax-in-2022\/\">do not pay taxes<\/a> on their investments and earnings even when rules exist.
