Blockchain Association CEO Kristin Smith commented on those events on June 6, <a href=\"https:\/\/twitter.com\/BlockchainAssn\/status\/1666089878940176388\">stating<\/a>:<\/p>\n<blockquote><p>\u201cThe SEC doesn\u2019t make the law \u2013 it only makes accusations \u2013 and we\u2019re confident the courts will prove [Securities and Exchange Commission] Chair [Gary] Gensler wrong in due time.&#8221;<\/p><\/blockquote>\n<p>She said that, despite Gensler's claims, there is no regulatory clarity for the crypto industry. She also expressed support for a Republican <a href=\"https:\/\/cryptoslate.com\/republican-lawmakers-distinguish-crypto-commodities-and-securities-in-draft-bill\/\">discussion draft<\/a> that could create clear regulation and &#8220;reign in Chair Gensler\u2019s relentless crusade.&#8221; Smith said that her group will advocate for its members and fight the SEC in court.<\/p>\n<p>In a separate interview with Forbes on <a href=\"https:\/\/www.forbes.com\/sites\/stevenehrlich\/2023\/06\/07\/secs-crypto-campaign-unlikely-to-stop-at-binance-and-coinbase\/?sh=66c4798c2e38\">June 7<\/a>, Smith said that the SEC could take action against other companies. However, she believes the SEC's existing action against Coinbase has already sent the &#8220;message that [Gensler] wanted to send.&#8221;<\/p>\n<h2>Chief Policy officer also comments<\/h2>\n<p>Other members of the Blockchain Association have also commented. Chief Policy Officer Jake Chervinsky <a href=\"https:\/\/twitter.com\/jchervinsky\/status\/1666517974650331152\">said that<\/a> the SEC's description of investment contracts is so broad that &#8220;basically all luxury goods in existence,&#8221; from watches to cars, could be securities.<\/p>\n<p>The SEC alleged in its case against Coinbase that the firm's staking program and crypto listings are investment contracts. It also said that &#8220;novel investment vehicles&#8221; such as orange groves and mobile phones have been found to be investment contracts.<\/p>\n<p>Chervinsky further criticized the SEC's treatment of <a href=\"https:\/\/twitter.com\/jchervinsky\/status\/1666080613559070726\">Coinbase's business model<\/a> and hurting those who invested in the company's stock. He <a href=\"https:\/\/twitter.com\/jchervinsky\/status\/1666093204859666438\">echoed Smith's comments<\/a> on the lack of clarity and the SEC's possible loss in court.<\/p>\n<p>Coinbase has not yet announced its full plans to fight the SEC. It is currently persisting with its petition for rulemaking, CLO Paul Grewal stated on <a href=\"https:\/\/twitter.com\/iampaulgrewal\/status\/1666234163110748160?ref_src=twsrc%5Egoogle%7Ctwcamp%5Eserp%7Ctwgr%5Etweet\">June 6<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Members of the Blockchain Association have commented on recent actions from the U.S. Securities and Exchange Commission (SEC).
