Warren Davidson (R-Ohio) announced legislation to remove Securities and Exchange Commission (SEC) chair Gary Gensler in a tweet on <a href=\"https:\/\/twitter.com\/WarrenDavidson\/status\/1647572722958974983\">April 16<\/a>.<\/p>\n<h2>Davidson announces anti-Gensler legislation<\/h2>\n<p>On Twitter, Davidson wrote:<\/p>\n<blockquote><p>\u201cTo correct a long series of abuses, I am introducing legislation that removes the Chairman of the [SEC] and replaces the role with an Executive Director that reports to the Board (where authority resides).\u201d<\/p><\/blockquote>\n<p>Davidson also said that former SEC chairs are \u201cineligible\u201d for the downgraded position. If the legislation were to succeed, Gensler would no longer be able to serve in a leadership capacity at the Commission but presumably could serve in another role.<\/p>\n<p>Davidson announced the legislation in response to Coinbase CLO Paul Grewal, whose original tweet concerned the SEC's <a href=\"https:\/\/cryptoslate.com\/sec-reopens-comments-on-proposed-changes-to-exchange-definition\/\">pursuit of a broadened definition<\/a> of \u201cexchange.\u201d That broadened definition could impact DeFi platforms and other services not typically considered exchanges \u2014 a possibility that the SEC itself has observed.<\/p>\n<p>Davidson appears to be acting in response to a Twitter campaign urging for Gensler's removal. In late March, he wrote: &#8220;<span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\">Let\u2019s make the <\/span><span class=\"r-18u37iz\">#FireGary<\/span><span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\"> movement bipartisan!<\/span>&#8221;<\/p>\n<h2>Gensler, SEC face longstanding criticism<\/h2>\n<p>Davidson has criticized Gensler and the SEC in the past. In November 2022, he <a href=\"https:\/\/twitter.com\/WarrenDavidson\/status\/1591817424583929856\">accused<\/a> Gensler and the SEC of selective enforcement following the collapse of FTX.<\/p>\n<p>In October 2022, <a href=\"https:\/\/twitter.com\/warrendavidson\/status\/1576924683274194950\">he criticized<\/a> the SEC's decision to <a href=\"https:\/\/cryptoslate.com\/kim-kardashian-to-pay-sec-1-26m-for-promoting-emax-security-token\/\">fine Kim Kardashian<\/a> over her cryptocurrency promotions. At that time, Davidson wrote that the SEC's &#8220;<span class=\"css-901oao css-16my406 r-poiln3 r-bcqeeo r-qvutc0\">incoherent&#8221; and &#8220;inconsistent&#8221; enforcement<\/span> policies would force crypto innovation overseas.<\/p>\n<p>In February 2023, he <a href=\"https:\/\/twitter.com\/WarrenDavidson\/status\/1625215670731390976\">accused<\/a> the SEC of regulating by enforcement when it <a href=\"https:\/\/cryptoslate.com\/kraken-to-end-staking-in-30m-sec-settlement\/\">sued Kraken<\/a> over its staking services. The SEC also forced Kraken to discontinue staking in the U.S.<\/p>\n<p>The SEC's board of commissioners currently has five members. Two commissioners \u2014\u00a0 Hester Peirce and Mark Uyeda \u2014 have regularly dissented from the regulator's strict decisions around crypto policy, including some of the above issues.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rep.
