{"id":313914,"date":"2023-03-30T22:19:40","date_gmt":"2023-03-30T21:19:40","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=313914"},"modified":"2023-03-31T02:33:56","modified_gmt":"2023-03-31T01:33:56","slug":"coinbase-kraken-plan-to-continue-operating-in-canada-as-regulatory-rules-change","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/coinbase-kraken-plan-to-continue-operating-in-canada-as-regulatory-rules-change\/","title":{"rendered":"Coinbase, Kraken plan to continue operating in Canada as regulatory rules change"},"content":{"rendered":"<p>Crypto exchanges Coinbase and Kraken have stated that they plan to continue operating in Canada.<\/p>\n<h2>Coinbase says it will serve Canadians<\/h2>\n<p>Coinbase said in a <a href=\"https:\/\/www.coinbase.com\/blog\/building-for-canada-and-the-world-from-canada\">March 30<\/a> blog post that Coinbase Canada has signed an enhanced pre-registration undertaking with Canadian securities regulators.<\/p>\n<p>The company added that its Canadian presence is part of its international expansion efforts. Coinbase said it has created a &#8220;tech hub&#8221; in Canada with more than 200 engineers and said that its global team will visit Canada on a regular basis.<\/p>\n<p>Coinbase also said that it has hired Lucas Matheson, a former Senior Director of Operations at Shopify, to direct Coinbase's Canadian operations from Ottawa.<\/p>\n<p>The company's announcement implied that its interactions with Canadian regulators were favorable. Its various statements suggest that the country's regulatory framework provides clarity, permits innovation, and protects consumers.<\/p>\n<p>By contrast, Coinbase is currently locked in a dispute with U.S. Securities regulators, which have <a href=\"https:\/\/cryptoslate.com\/coinbase-receives-wells-notice-from-sec\/\">sent the firm a Wells notice<\/a> in advance of possible legal action.<\/p>\n<h2>Kraken to also operate in Canada<\/h2>\n<p>Kraken <a href=\"https:\/\/www.businesswire.com\/news\/home\/20230330005087\/en\/Kraken-Reaffirms-Commitment-to-Driving-Crypto-Adoption-in-Canada\">also said<\/a> it has filed a pre-registration undertaking with Canada's Ontario Securities Commission (OSC) and aims to become a registered Restricted Dealer in the country.<\/p>\n<p>COO David Ripley called Canada a region that is &#8220;critical to [Kraken's] mission.&#8221; The company emphasized its local presence by stating that it has served Canadian users for over ten years and has more than 250 employees in the country.<\/p>\n<p>Kraken also highlighted the rate of crypto adoption in Canada in a separate <a href=\"https:\/\/blog.kraken.com\/post\/18260\/kraken-remains-committed-to-canada\/\">blog post<\/a>. There, it cited statistics from the OSC itself showing that 13% of Canadians currently own cryptocurrency and that 31% of Canadians plan to purchase crypto in one year.<\/p>\n<p>The company said that, despite its commitment, it will make &#8220;certain changes&#8221; to the services that it offers in Canada in order to remain in line with the new rules.<\/p>\n<h2>Canadian rules affect multiple exchanges<\/h2>\n<p>Kraken's change in policy is due to rules that are <a href=\"https:\/\/cryptoslate.com\/canada-requires-crypto-exchanges-to-pre-register-within-30-days\/\">currently being introduced<\/a> by Canadian securities regulators. These rules required crypto exchanges to pre-register within 30 days of Feb. 22, in order to continue operating in the country.<\/p>\n<p>Under the new rules, exchanges must segregate crypto assets held by Canadian users and refrain from offering certain services. These requirements came after the collapses of U.S.-based crypto platforms, and the failures of <a href=\"https:\/\/cryptoslate.com\/companies\/ftx\/\">FTX<\/a>, <a href=\"https:\/\/cryptoslate.com\/companies\/celsius-network\/\">Celsius<\/a>, <a href=\"https:\/\/cryptoslate.com\/companies\/blockfi\/\">BlockFi<\/a>, <a href=\"https:\/\/cryptoslate.com\/companies\/genesis\/\">Genesis<\/a>, and <a href=\"https:\/\/cryptoslate.com\/companies\/voyager\">Voyager Digital<\/a> are explicitly named in a government statement.<\/p>\n<p>Kraken and Coinbase are among the first exchanges to officially declare their intent to remain in Canada. According to the Canadian Securities Administrators, <a href=\"https:\/\/www.securities-administrators.ca\/crypto-trading-platforms-regulation-and-enforcement-actions\/crypto-trading-platforms-that-have-filed-pre-registration-undertakings\/\">just one other exchange<\/a> \u2014 Crypto.com\u00a0 \u2014 has filed a pre-registration undertaking.<\/p>\n<p>Blockchain.com has stated <a href=\"https:\/\/www.blockchain.com\/legal\/terms\">on its website<\/a> that it will suspend Canadian custodial and exchange services.
