{"id":299751,"date":"2023-02-16T02:43:18","date_gmt":"2023-02-16T02:43:18","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=299751"},"modified":"2023-02-16T18:36:12","modified_gmt":"2023-02-16T18:36:12","slug":"coinbase-bitgo-and-anchorage-assert-that-they-comply-with-sec-custody-rules","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/coinbase-bitgo-and-anchorage-assert-that-they-comply-with-sec-custody-rules\/","title":{"rendered":"Coinbase, BitGo, and Anchorage Digital assert that they comply with SEC custody rules"},"content":{"rendered":"<p>Coinbase and other crypto custody providers asserted on Feb. 15 that they will be able to operate under proposed changes to custodial rules.<\/p>\n<h2>Coinbase endorses SEC's efforts<\/h2>\n<p>Today, the U.S. SEC voted to propose a <a href=\"https:\/\/cryptoslate.com\/sec-suggests-including-crypto-into-federal-custody-rules\/\">regulatory change<\/a> that could require exchanges to store user assets with qualified custodians. This would also update rules for custodians, possibly making it difficult for existing crypto companies to offer custody services.<\/p>\n<p>Coinbase chief legal officer Paul Grewal <a href=\"https:\/\/twitter.com\/iampaulgrewal\/status\/1625946785360523264\">stated on Twitter<\/a> that his company is &#8220;confident&#8221; that it will remain a qualified custodian under the proposed rule change. He added that Coinbase endorses the U.S. Securities and Exchange Commission's efforts to provide investor protections and supports the public rulemaking process.<\/p>\n<p>In a <a href=\"https:\/\/www.bnnbloomberg.ca\/coinbase-says-it-already-complies-with-sec-s-crypto-custody-proposal-1.1884421\">Bloomberg<\/a> interview, Grewal said: &#8220;we see SEC officials recognize that specifically, Coinbase is operating in a qualified manner.&#8221; However, he did not state what sort of acknowledgment this amounts to on the part of the regulator.<\/p>\n<p>In a separate interview with <a href=\"https:\/\/www.cnbc.com\/video\/2023\/02\/15\/coinbases-paul-grewal-reacts-to-the-secs-proposed-rule-change-targeting-crypto.html\">CNBC<\/a>, Grewal was asked what Coinbase would do if U.S. regulators forced the company to shut down its custody services. Grewal answered that Coinbase has &#8220;a very diversified business&#8221; in services and countries served, implying that the company could shift its focus elsewhere.<\/p>\n<h2>Other companies comment on proposal<\/h2>\n<p>Coinbase's stance on the matter is notable as it is likely the largest crypto custody provider. It has $90 billion of assets under custody, based on numbers from <a href=\"https:\/\/www.blockdata.tech\/blog\/general\/crypto-custody-providers-compared-2021\">BlockData<\/a>.<\/p>\n<p>Only a few other crypto custody providers have made statements on the matter. BitGo \u2014 the next largest provider, with $64 billion of assets under custody \u2014 similarly reassured its clients that it will remain a qualified custodian <a href=\"https:\/\/twitter.com\/BitGo\/status\/1625965706218213376?cxt=HHwWgMDUgb7My5AtAAAA\">via Twitter<\/a>.<\/p>\n<p>Anchorage Digital, in a statement to Coindesk today, also said that it is &#8220;unequivocally&#8221; a qualified custodian and stated that it should be able to operate under the proposed rules.<\/p>\n<p>Despite apparent support from custody providers, the proposed regulatory change would raise requirements for companies that wish to provide custody. <a href=\"https:\/\/theblockchainassociation.org\/blockchain-association-reacts-to-proposed-sec-custody-rule\/\">The Blockchain Association<\/a> has gone as far as to say that the proposed change is &#8220;bad policy&#8221; that could &#8220;restrict or prohibit&#8221; investors from engaging with the crypto industry.<\/p>\n<p>The proposed change would affect investment advisors and crypto firms, and the SEC will accept comments from all concerned parties in the coming months.
