{"id":299441,"date":"2023-02-15T19:02:36","date_gmt":"2023-02-15T19:02:36","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=299441"},"modified":"2023-02-15T19:03:50","modified_gmt":"2023-02-15T19:03:50","slug":"us-crypto-regulation-on-track-despite-recent-sec-enforcement-actions","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/us-crypto-regulation-on-track-despite-recent-sec-enforcement-actions\/","title":{"rendered":"US crypto regulation on track despite recent SEC enforcement actions"},"content":{"rendered":"<p>Despite recent SEC enforcement actions against Kraken and Paxos, <span id=\"page108R_mcid711\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Jeff Zelkowitz, Executive Vice President at APCO Worldwide, said there is appetite and willingness among U.S. lawmakers to &#8220;get something done.&#8221;<br \/>\n<\/span><\/span><\/p>\n<p><span id=\"page108R_mcid711\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Zelkowitz shared his U.S. regulatory outlook in <a href=\"https:\/\/s3.coinmarketcap.com\/uploads\/2023-cmc-crypto-playbook-en.pdf\">CoinMarketCap's 2023 Crypto Playbook<\/a>. <\/span><\/span>The Playbook covered what may lie ahead for various sectors, including DeFi and user adoption, according to leading figures in the space.<\/p>\n<p>Crypto regulation was a pressing issue last year, featuring numerous flash points such as the Tornado Cash sanctions and the EU's Markets in Crypto-Assets (MiCA) legislation singling out stablecoins.<\/p>\n<p>For 2023, <span id=\"page108R_mcid711\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Zelkowitz<\/span><\/span> concedes there is a long road ahead, but he sees lawmakers making concerted efforts in the right direction.<\/p>\n<h2>U.S. crypto regulation is a mess<\/h2>\n<p>Recent enforcement actions have fostered the narrative that the SEC is hellbent on hampering the U.S. crypto industry, ultimately driving innovation to friendlier jurisdictions.<\/p>\n<p>However, <span id=\"page108R_mcid711\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Zelkowitz has a different take on the matter. He talked about a desire from both political parties to cement U.S. financial dominance, using technology to do so. <\/span><\/span>At the same time, Zelkowitz conceded that lawmakers must balance this with tackling bad actors.<\/p>\n<blockquote><p><span dir=\"ltr\" role=\"presentation\">&#8220;What is clear is that U.S. policymakers from both <\/span><span dir=\"ltr\" role=\"presentation\">major parties want to reinforce American leadership in the global financial system and at the <\/span><span dir=\"ltr\" role=\"presentation\">technological frontier \u2013 while defending this frontier against bad actors.&#8221;<\/span><\/p><\/blockquote>\n<p>A key criticism of the U.S. regulatory approach to digital assets is the lack of a unified framework. The upshot of this means oversight is done through a jumble of state and federal financial regulators applying existing legislation. Some argue that this method cannot appropriately capture the nuances of cryptocurrencies.<\/p>\n<p>Adopting this approach also creates an overlap, even friction, between different regulators, further muddying the waters on compliance.<\/p>\n<h2>The U.S. regulatory outlook<\/h2>\n<p>Recent efforts to rectify this issue include the <a href=\"https:\/\/cryptoslate.com\/white-house-releases-inaugural-framework-for-crypto-regulation\/\"><span dir=\"ltr\" role=\"presentation\">White House's Executive Order<\/span><\/a> and <span dir=\"ltr\" role=\"presentation\">Senators Gillibrand and Lummis's proposal for the <\/span><span dir=\"ltr\" role=\"presentation\">Responsible Financial <\/span><span dir=\"ltr\" role=\"presentation\">Innovation Act, which <\/span><span dir=\"ltr\" role=\"presentation\"><span id=\"page108R_mcid711\" class=\"markedContent\">Zelkowitz cited as evidence of the <\/span><\/span><span dir=\"ltr\" role=\"presentation\">&#8220;collegial tone&#8221; between U.S. lawmakers in pushing for appropriate crypto regulation.<br \/>\n<\/span><\/p>\n<p>However, this momentum came unstuck due to the <span id=\"page104R_mcid623\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">U.S. midterm elections and the FTX collapse, <span id=\"page108R_mcid711\" class=\"markedContent\">Zelkowitz <\/span>said.<\/span><\/span><\/p>\n<p>Referring to several high-profile SEC enforcement actions, including the ongoing case against Ripple, <span id=\"page104R_mcid623\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><span id=\"page108R_mcid711\" class=\"markedContent\">Zelkowitz<\/span><\/span><\/span> admitted that the general public has been &#8220;roiled&#8221; by the apparent unfairness of the case. But he explained the agency's stance as grounded in decades-old securities legislation.<\/p>\n<p>In turn, this is opening up calls for the CFTC to step in and make its mark &#8211; a move championed by some who view the CFTC as a &#8220;<a href=\"https:\/\/www.linkedin.com\/news\/story\/ftx-sought-friendlier-regulators-5503220\/\">softer touch<\/a>&#8221; compared to the SEC.<\/p>\n<p>Regardless of whether that is the case or not, there remains a gulf to close in deciding how to move forward, starting with the classification of cryptocurrencies as either securities or commodities.<\/p>\n<p><span id=\"page104R_mcid623\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\"><span id=\"page108R_mcid711\" class=\"markedContent\">Zelkowitz<\/span><\/span><\/span> acknowledged there is much more work to do in shaping an appropriate framework.
