{"id":298173,"date":"2023-02-13T07:30:03","date_gmt":"2023-02-13T07:30:03","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=298173"},"modified":"2023-02-13T09:16:49","modified_gmt":"2023-02-13T09:16:49","slug":"the-sec-may-potentially-sue-paxos-over-binanceusd-wsj","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/the-sec-may-potentially-sue-paxos-over-binanceusd-wsj\/","title":{"rendered":"The SEC may potentially sue Paxos over BinanceUSD &#8211; WSJ"},"content":{"rendered":"<p>The U.S. Securities and Exchange Commission (SEC) enforcement division has issued a Wells notice to Paxos \u2014 The Wall Street Journal (WSJ) reported, citing anonymous sources.<\/p>\n<p>The New York Department of Financial Services instructed Paxos Trust Co. \u2014 the issuer of stablecoin Binance USD (<a href=\"https:\/\/cryptoslate.com\/coins\/binance-usd\/\">BUSD<\/a>) \u2014 to halt any further creation of BUSD, <a href=\"https:\/\/www.wsj.com\/articles\/crypto-firm-paxos-to-stop-issuing-dollar-pegged-binance-token-94f65e52?mod=markets_minor_pos10\">according<\/a> to the WSJ.<\/p>\n<h2>The Wells notice<\/h2>\n<p>A Wells notice is a formal notice the SEC issues to inform the recipient that it plans to bring enforcement actions against it.<\/p>\n<p>The SEC plans to sue Paxos for allegedly violating securities and investor protection laws. BUSD\u00a0is considered an unregistered security, according to the notice.<\/p>\n<p>Paxos issued the 1:1 dollar-pegged stablecoin in partnership with Binance in September 2019. Since then, BUSD has grown to be the third-largest stablecoin and the seventh-largest cryptocurrency \u2014 with a market cap of $16.15 billion\u00a0 \u2014 according to <em>CryptoSlate<\/em> data.<\/p>\n<h2>What happens next<\/h2>\n<p>A Wells notice does not mean that the SEC will take enforcement action. The five commissioners of the SEC have to vote to authorize any enforcement litigation or settlement by the agency.<\/p>\n<p>Paxos can submit a written response to the Wells notice and present its case as to why it should not be sued.<\/p>\n<p>When the SEC nearly <a href=\"https:\/\/cryptoslate.com\/sec-expands-crypto-team-to-bolster-consumer-protection-efforts\/\">doubled<\/a> its Crypto Assets and Cyber Unit in May 2022, it said that stablecoins would be an <a href=\"https:\/\/www.sec.gov\/news\/press-release\/2022-78\">area of focus<\/a>.
