{"id":287892,"date":"2023-01-11T11:35:59","date_gmt":"2023-01-11T11:35:59","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=287892"},"modified":"2023-01-11T11:26:16","modified_gmt":"2023-01-11T11:26:16","slug":"thailand-sec-probes-zipmex-for-offering-unregistered-earn-products","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/thailand-sec-probes-zipmex-for-offering-unregistered-earn-products\/","title":{"rendered":"Thailand SEC to probe Zipmex over unregistered earn products"},"content":{"rendered":"<p>The Securities and Exchange Commission (SEC) of Thailand is investigating Zipmex to ascertain if its earn products breached regulatory rules.<\/p>\n<p>According to a <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2023-01-11\/thailand-probes-embattled-crypto-exchange-zipmex-on-rule-breach?sref=323RPL5z\">Bloomberg News<\/a> report, Thailand's SEC sent a letter to Zipmex on Dec. 28 stating that the ZipUp and ZipUP+ products were in violation of the digital-asset business rules.<\/p>\n<p>Zipmex allowed its customers to earn returns for holding their assets in the ZipUp and ZipUp+ earn products.<\/p>\n<p>Due to the nature of Zipmex's earn products, the SEC alleged that the exchange was unduly operating as a fund manager.<\/p>\n<blockquote><p>&#8220;The company could have been operating as a digital-asset fund manager without permission,&#8221; the SEC said.<\/p><\/blockquote>\n<p>The SEC has urged Zipmex to come forward to clarify its status on or before Jan. 12.<\/p>\n<p>The SEC's investigation is coming barely a month after it was reported that venture capital firm V Ventures would proceed to <a href=\"https:\/\/cryptoslate.com\/struggling-zipmex-exchange-in-negotiations-over-a-buyout-offer\/\">acquire<\/a> the exchange for $100 million.<\/p>\n<h2>Zipmex's battle with SEC<\/h2>\n<p>In an <a href=\"https:\/\/cryptoslate.com\/zipmex-facing-legal-battle-with-thailand-sec-over-non-compliance\/\">earlier investigation,<\/a> the SEC accused Zipmex CEO Eklarp Yimwilai of failing to submit comprehensive information about how it managed customers' assets.<\/p>\n<p>Back in July 2022, Zipmex <a href=\"https:\/\/cryptoslate.com\/crypto-exchange-zipmex-halts-withdrawals-citing-market-volatility\/\">halted withdrawals<\/a> due to insolvency concerns. The SEC moved to <a href=\"https:\/\/cryptoslate.com\/thai-sec-seeks-clarification-from-zipmex-on-withdrawal-freeze\/\">probe<\/a> the exchange and requested access to transaction records and wallets used to hold customers' assets.<\/p>\n<p>In response, Zipmex <a href=\"https:\/\/zipmex.com\/th\/en\/announcements\/wallet-address-change-th-060922\/\">claimed<\/a> it was treading with caution in submitting the documents as its parent company &#8216;Zipmex Pte.
