{"id":281369,"date":"2022-12-13T11:32:42","date_gmt":"2022-12-13T11:32:42","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=281369"},"modified":"2023-08-22T02:39:57","modified_gmt":"2023-08-22T01:39:57","slug":"sec-charges-sbf-with-defrauding-investors","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/sec-charges-sbf-with-defrauding-investors\/","title":{"rendered":"SEC charges SBF with defrauding investors"},"content":{"rendered":"<p><em>Article updated 13:10 UTC to add details.<\/em><\/p>\n<p>The Securities and Exchange Commission (SEC) charged Sam Bankman-Fried (SBF) on Dec. 13, with \u201corchestrating a scheme to defraud equity investors in FTX Trading Ltd (FTX).\u201d<\/p>\n<p>The SEC stated that SBF \u201cconcealed his diversion of FTX customers\u2019 funds to crypto trading firm Alameda Research while raising more than $1.8 billion from investors.\u201d<\/p>\n<p>Since May 2019, FTX raised over $1.8 billion from equity investors, according to the SEC <a href=\"https:\/\/www.sec.gov\/news\/press-release\/2022-219\">press release<\/a> \u2014 which clarified:<\/p>\n<blockquote><p>\u201cIncluding $1.1 billion from approximately 90 U.S.-based investors.\u201d<\/p><\/blockquote>\n<p>SBF promoted FTX as both a safe and responsible crypto asset trading platform, \u201cspecifically touting FTX\u2019s sophisticated, automated risk measure to protect customer assets.\u201d<\/p>\n<p>However, the SEC complaint alleged that \u201cin reality,\u201d SBF orchestrated a \u201cyears-long fraud to conceal from FTX\u2019s investors\u201d three undisclosed fraudulent actions:<\/p>\n<ul>\n<li>\u201cThe undisclosed diversion of FTX customers\u2019 funds to Alameda Research LLC, his privately-held crypto hedge fund.\u201d<\/li>\n<li>\u201cThe undisclosed special treatment afforded to Alameda on the FTX platform, including providing Alameda with a virtually unlimited \u201cline of credit\u201d funded by the platform\u2019s customers and exempting Alameda from certain key FTX risk mitigation measures.\u201d<\/li>\n<li>\u201cUndisclosed risk stemming from FTX\u2019s exposure to Alameda\u2019s significant holdings of overvalued, illiquid assets such as FTX-affiliated tokens. The complaint further alleges that Bankman-Fried used commingled FTX customers\u2019 funds at Alameda to make undisclosed venture investments, lavish real estate purchases, and large political donations.<\/li>\n<\/ul>\n<p>The SEC has charged SBF with violation of anti-fraud provisions of the Securities Act 1933 and the Securities Exchange Act of 1934.<\/p>\n<p>Overseeing the SEC Chair, Gary Gensler said:<\/p>\n<p>\u201cWe allege that Sam Bankman-Fried built a house of cards on a foundation of deception while telling investors that it was one of the safest buildings in crypto.\u201d<\/p>\n<p>Highlighting trading platform conduct for both investors and regulators, Gensler warned that for \u201cplatforms that don\u2019t comply with our securities laws, the SEC\u2019s Enforcement Division is ready to take action.\u201d<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Article updated 13:10 UTC to add details.
