{"id":279849,"date":"2022-12-06T22:45:25","date_gmt":"2022-12-06T22:45:25","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=279849"},"modified":"2023-08-27T12:47:03","modified_gmt":"2023-08-27T11:47:03","slug":"elizabeth-warren-led-cryptocurrency-bill-in-works-may-give-sec-most-regulatory-authority","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/elizabeth-warren-led-cryptocurrency-bill-in-works-may-give-sec-most-regulatory-authority\/","title":{"rendered":"Elizabeth Warren led cryptocurrency bill in works, may give SEC most regulatory authority"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">Senator Elizabeth Warren is <a href=\"https:\/\/www.semafor.com\/article\/12\/06\/2022\/warren-crypto-plan\">working<\/a> on a sweeping cryptocurrency bill that would give most cryptocurrency regulatory authority to the Securities and Exchange Commission, according to sources close to her.<\/span><\/p>\n<blockquote><p><span style=\"font-weight: 400;\">\u201cAs Senator Warren has already said publicly, she\u2019s working on crypto legislation and believes that financial regulators, including the SEC, have broad existing authority to crack down on crypto fraud and illegal money laundering,\u201d Alex Sarabia, a Warren spokesperson, said in a statement to Semafor.<\/span><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">Warren's office is investigating crypto-related issues, including taxation, regulation, climate, and national security, according to details by Semafor, which &#8220;could change.&#8221;\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Following the collapse of the crypto exchange FTX, the senator <\/span><a href=\"https:\/\/www.politico.com\/news\/2022\/11\/15\/ftx-sec-cftc-crypto-regulations-00067040\"><span style=\"font-weight: 400;\">demanded<\/span><\/a><span style=\"font-weight: 400;\"> new regulations to govern the crypto space.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Among Warren's proposals were the following:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">\u00a0Ensure brokers and crypto exchanges comply with certain regulatory requirements, such as providing audited financial statements and mandating capital requirements similar to banks.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Securing customer deposits so they are never combined with company assets and keeping them separate so they can't be used to finance other investments if a company goes bankrupt. <\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">To address these, Warren recently <a href=\"https:\/\/www.wsj.com\/articles\/regulate-crypto-or-itll-take-down-the-economy-fraud-reporting-know-your-customer-loophole-energy-disclosure-ftx-bankman-fried-ftx-11669123750\">urged<\/a> the SEC and other federal regulators to fight crypto fraud more aggressively and called on Congress to provide more funding to law enforcement agencies and financial regulators to close regulatory gaps.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Worth noting that cryptocurrencies are difficult to regulate in the US due to a lack of federal regulatory authority. Bitcoin is regulated as a commodity, by the Commodity Futures Trading Commission (CFTC), in the exchange-traded fund category by the Securities and Exchange Commission (SEC), and in the property category by the Internal Revenue Service (IRS),\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It is not the first time Elizabeth Warren is working on a crypto regulatory bill. She <\/span><a href=\"https:\/\/www.govtrack.us\/congress\/bills\/117\/s3867\"><span style=\"font-weight: 400;\">introduced<\/span><\/a><span style=\"font-weight: 400;\"> one in March to regulate cryptocurrency and sanction Russia simultaneously.
