{"id":276070,"date":"2022-11-18T09:30:57","date_gmt":"2022-11-18T09:30:57","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=276070"},"modified":"2023-09-19T17:08:56","modified_gmt":"2023-09-19T16:08:56","slug":"bahamas-ordered-ftx-to-send-digital-assets-under-its-control","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/bahamas-ordered-ftx-to-send-digital-assets-under-its-control\/","title":{"rendered":"Bahamas watchdog ordered FTX to send digital assets to its wallet"},"content":{"rendered":"<p>The Securities Commission of Bahamas\u00a0<a href=\"https:\/\/twitter.com\/SCBgov_bs\/status\/1593395137786171393?s=20&t=eMMrSh4vShtuZdTHT-pkOQ\"><span class=\"s4\">revealed<\/span><\/a> on Nov. 18 that it directed FTX to transfer digital assets under its control to the Commission\u2019s wallet on Nov. 12.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Securities Commission of The Bahamas Assumes Control of Assets of FTX Digital Markets Ltd. <a href=\"https:\/\/t.co\/IzW4PGZSJm\">pic.twitter.com\/IzW4PGZSJm<\/a><\/p>\n<p>&mdash; Securities Commission of The Bahamas (@SCBgov_bs) <a href=\"https:\/\/twitter.com\/SCBgov_bs\/status\/1593395137786171393?ref_src=twsrc%5Etfw\">November 18, 2022<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>According to the regulator, the directive was aimed at \u201csafekeeping\u201d the assets and \u201cwas necessary to protect the interests of clients and creditors\u201d of the bankrupt exchange.<\/p>\n<h2>FTX court filing reveals the firm sent assets to Bahamas authorities<\/h2>\n<p>A Nov. 17 court <a href=\"https:\/\/pacer-documents.s3.amazonaws.com\/33\/188450\/042120648186.pdf\">filing<\/a> from FTX revealed that it has recorded and verified text evidence that the Bahamas regulators directed the unauthorized access and withdrawal from the bankrupt exchange.<\/p>\n<p>According to the filing, former CEO Sam Bankman-Fried and CTO Gary Wang were behind the Nov. 13 events. The exchange said the assets were \u201ccustodied on FireBlocks under control of Bahamian gov\u2019t.\u201d<\/p>\n<blockquote><p>&#8220;The Debtors thus have credible evidence that the Bahamian government is responsible for directing unauthorized access to the Debtors\u2019 systems for the purpose of obtaining digital assets of the Debtors\u2014that took place after the commencement of these cases.&#8221;<\/p><\/blockquote>\n<p>FTX also challenged the complaint filed by the Bahamas-government <a href=\"https:\/\/cryptoslate.com\/bahamas-supreme-court-appoints-liquidators-for-ftx-assets\/\">appointed<\/a> liquidators in New York. The liquidators had filed a Chapter 15 in a New York court requesting the court to grant it control of the proceedings in the Bahamas.<\/p>\n<p>According to FTX, the Chapter 15 filing should be transferred from the New York court to Delaware to avoid &#8220;potentially inconsistent opinions, duplication of efforts, and unnecessary expense.&#8221;<\/p>\n<p>FTX also argued that the Bahamas-appointed liquidators did not mention its intention to file a Chapter 15 case in a new court in the United States.<\/p>\n<p>The Bahamas regulator had earlier <a href=\"https:\/\/cryptoslate.com\/bahamas-securities-commission-neither-authorized-nor-condones-ftx-enabling-local-withdrawals\/\">said<\/a> it did not instruct FTX to prioritize the withdrawal of Bahamian assets.<\/p>\n<p>Reports had <a href=\"https:\/\/cryptoslate.com\/ftx-hacker-is-now-one-of-the-largest-eth-holders\/\">revealed<\/a> that the FTX hacker was the 35th-largest holder of Ethereum. The hacker's address holds a total of 228,523 <a href=\"https:\/\/cryptoslate.com\/coins\/ethereum\/\">ETH<\/a> worth $284.82 million.
