{"id":272068,"date":"2022-11-02T11:00:17","date_gmt":"2022-11-02T11:00:17","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=272068"},"modified":"2022-11-02T10:56:09","modified_gmt":"2022-11-02T10:56:09","slug":"europe-targets-crypto-influencers-with-new-mica-clause","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/europe-targets-crypto-influencers-with-new-mica-clause\/","title":{"rendered":"Europe targets crypto influencers with new MiCA clause"},"content":{"rendered":"<p>The EU\u2019s Markets in Crypto Assets (MiCA) bill could significantly impact crypto influencers as some clauses hint at strict regulation.<\/p>\n<p>Circle\u2019s EU strategy and policy director, Patrick Hansen, pointed this out, saying that commenting on a digital asset and profiting from it without disclosure could be termed market manipulation.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Crypto influencers beware: Commenting on crypto assets in (social) media without disclosure and profiting from the effects of that will be considered market manipulation in the EU once MiCA is in force.<a href=\"https:\/\/twitter.com\/zachxbt?ref_src=twsrc%5Etfw\">@zachxbt<\/a> <a href=\"https:\/\/t.co\/BflVXPazjS\">pic.twitter.com\/BflVXPazjS<\/a><\/p>\n<p>&mdash; Patrick Hansen (@paddi_hansen) <a href=\"https:\/\/twitter.com\/paddi_hansen\/status\/1587368545264242689?ref_src=twsrc%5Etfw\">November 1, 2022<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>Hansen shared the screenshot of the clause, which part of it reads:<\/p>\n<blockquote><p>&#8220;Taking advantage of occasional or regular access to the traditional or electronic media by voicing an opinion about a crypto-asset, while having previously taken positions on that crypto-asset, and profiting subsequently from the impact of the opinions voiced on the price of that crypto-asset, without having simultaneously disclosed that conflict of interest to the public in a proper and effective way.&#8221;<\/p><\/blockquote>\n<p>While the clause is ambiguous and leaves room for multiple interpretations, its existence shows that the EU might take action against those who promote crypto assets without disclosing their interests.<\/p>\n<p>The revelation has elicited mixed reactions from the community, with many describing it as <a href=\"https:\/\/twitter.com\/LovelyFeyd\/status\/1587372685528530945?s=20&t=BHvtjV2PVBzQjj6Yxj9NQQ\"><span class=\"s4\">helpful<\/span><\/a> in preventing shilling while others <a href=\"https:\/\/twitter.com\/danku_r\/status\/1587394575408193538?s=20&t=BHvtjV2PVBzQjj6Yxj9NQQ\"><span class=\"s4\">criticized<\/span><\/a> it because its application leaves much room for abuse. Questions were also <a href=\"https:\/\/twitter.com\/K_mpec80\/status\/1587380480869031938?s=20&t=BHvtjV2PVBzQjj6Yxj9NQQ\">raised<\/a> on why it applies to crypto and not stocks and other financial markets.<\/p>\n<p>Regulators around the world are increasingly paying attention to crypto influencers. The U.S. SEC recently <a href=\"https:\/\/cryptoslate.com\/kim-kardashian-to-pay-sec-1-26m-for-promoting-emax-security-token\/\">fined<\/a> Kim Kardashian $1.26 million for her undisclosed promotion of EthereumMAX(EMAX).<\/p>\n<p>Meanwhile, the MiCA bill is not scheduled to become law until 2024.
