{"id":267381,"date":"2022-10-11T18:13:06","date_gmt":"2022-10-11T17:13:06","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=267381"},"modified":"2023-06-30T22:34:01","modified_gmt":"2023-06-30T21:34:01","slug":"sec-rejects-wisdomtrees-spot-bitcoin-etf","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/sec-rejects-wisdomtrees-spot-bitcoin-etf\/","title":{"rendered":"SEC rejects WisdomTree&#8217;s Spot Bitcoin ETF"},"content":{"rendered":"<p>The U.S. Securities and Exchange Commission (SEC) has rejected the Wisdom Tree Bitcoin Trust ETF, as it has no valid measure to protect investors against market manipulation.<\/p>\n<p>The SEC in an<a href=\"https:\/\/www.sec.gov\/rules\/sro\/cboebzx\/2022\/34-96011.pdf\"> Oct. 11 release<\/a> noted that it had to reject the filing by BZX Exchange, as the bitcoin-ETF issuer does not have a significant surveillance sharing agreement with a regulated market for bitcoin.<\/p>\n<p>A surveillance-sharing agreement allows market participants to easily share market trading and clearing activist and customer identity in the event of any price manipulation of BTC.<\/p>\n<p>According to the SEC, the surveillance agreement is crucial before it can approve any spot bitcoin-ETF, given that the market for bitcoin is highly unregulated.<\/p>\n<p>The first Wisdom Tree spot bitcoin ETF was also <a href=\"https:\/\/www.sec.gov\/rules\/sro\/cboebzx\/2021\/34-93700.pdf\">rejected<\/a> in December 2021 on grounds of investor protection.<\/p>\n<h2>SEC and spot bitcoin ETF rejections<\/h2>\n<p>The SEC's decision to reject the Wisdom Tree ETF application is no surprise to many, as the US regulator has a long-standing history against bitcoin spot ETFs.<\/p>\n<p>The Winklevoss twins were the first to ever attempt to file a Bitcoin ETF in July 2013. However, the SEC rejected their application in March 2017.<\/p>\n<p>The VanEck Solidx ETF followed suit in July 2013, but it faced rejection in January 2019.<\/p>\n<p>In 2017, ProShares, Direxion, and GraniteShares attempted to have their respective applications approved, but the SEC hit the rejection dial.<\/p>\n<p>Bitwise, Wilshire, and Reality Shares ETF all had a rejection of applications they made in 2019.<\/p>\n<p>By mid-2020, Wisdom Tree submitted its first application, which the SEC rejected about a year later.<\/p>\n<p>VanEck refiled its application in January 2021, while\u00a0Fidelity, NYDIG, and GrayScale all filed for bitcoin ETFs in the same period.\u00a0 VanEck's application was <a href=\"https:\/\/cryptoslate.com\/heres-why-the-sec-rejected-the-much-anticipated-vaneck-bitcoin-spot-etf\/\">rejected<\/a> again in Nov. 2021.<\/p>\n<p>So far in 2022, the SEC has rejected applications by <a href=\"https:\/\/cryptoslate.com\/bitcoin-crashes-under-20k-as-sec-rejects-grayscale-spot-etf-application\/\">GrayScale,<\/a> <a href=\"https:\/\/cryptoslate.com\/sec-postpones-decision-on-bitwise-bitcoin-spot-etf-application-again\/\">BitWise,<\/a> and the latest Wisdom Tree.<\/p>\n<p>The growing list of rejected spot bitcoin ETF applications has been influenced by SEC Chair Gary Gensler.
