{"id":265942,"date":"2022-10-05T10:45:59","date_gmt":"2022-10-05T09:45:59","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=265942"},"modified":"2022-10-05T13:37:21","modified_gmt":"2022-10-05T12:37:21","slug":"us-consumer-protection-watchdog-warns-crypto-could-pose-risk-to-financial-stability","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/us-consumer-protection-watchdog-warns-crypto-could-pose-risk-to-financial-stability\/","title":{"rendered":"US consumer protection watchdog warns crypto could pose risk to financial stability"},"content":{"rendered":"<p>A federal U.S. government organization said crypto markets pose a threat to broader financial stability if they continue growing without more thoughtful oversight and enforcement.<\/p>\n<p>The <a href=\"https:\/\/home.treasury.gov\/policy-issues\/financial-markets-financial-institutions-and-fiscal-service\/fsoc\/about-fsoc\"> Financial Stability Oversight Council<\/a> (FSOC) is chaired by the Secretary of the Treasury, Janet Yellen, and is tasked with identifying risks and responding to threats to financial stability.<\/p>\n<h2>Crypto markets in the firing line<\/h2>\n<p>In a <a href=\"https:\/\/home.treasury.gov\/system\/files\/261\/Fact-Sheet-Report-on-Digital-Asset-Financial-Stability-Risks-and-Regulation.pdf\">report<\/a> released on Oct. 3, the FSOC mentioned &#8220;relatively limited&#8221; integration between crypto and legacy markets but warned that this could change &#8220;rapidly,&#8221; considering the growing popularity of digital assets in recent times.<\/p>\n<p>The report listed four specific crypto-threats that could spill over and negatively impact legacy markets. They were:<\/p>\n<ul>\n<li>Lack of controls in preventing run risks or sufficient oversight on excessive leverage.<\/li>\n<li>The price of crypto assets appeared to be speculation driven, making them highly volatile.<\/li>\n<li>Some crypto firms &#8220;<span id=\"page96R_mcid19\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">have risky business profiles and opaque capital and liquidity positions<\/span><\/span>.&#8221;<\/li>\n<li>The centralization of &#8220;key services&#8221; or vulnerabilities related to distributed ledger technology can lead to operational risks.<\/li>\n<\/ul>\n<p>Regarding adhering to existing regulatory structures, the FOSC said some crypto firms avoided regulatory systems. In contrast, others had actively participated by obtaining crypto-specific charters or licenses.<\/p>\n<p>Concerns were raised about misrepresentation, for example, false statements about <span id=\"page1R_mcid21\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">federal deposit insurance<\/span><\/span> and the degree to which some firms had advertised themselves as regulated \u2014 all of which give consumers a false sense of protection.<\/p>\n<p>To address regulatory gaps, the FOSC recommended spot cryptocurrencies not deemed securities fall under &#8220;<span id=\"page1R_mcid12\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">limited direct <\/span><span dir=\"ltr\" role=\"presentation\">federal regulation.&#8221; Implementing a regulatory arbitrage process would give authorities insight, supervise activities, and research into vertical integrations that offer retail consumers direct market access, leaving them exposed to practices such as automated liquidation.<\/span><\/span><\/p>\n<h2>The SEC comments on the FSOC report<\/h2>\n<p>SEC Chair <a href=\"https:\/\/www.sec.gov\/news\/statement\/gensler-statement-fsoc-meeting-100322\">Gary Gensler<\/a> released a statement in support of the FSOC's findings and recommendations.<\/p>\n<p>In addition, Gensler also picked up on several points raised by the FSOC, particularly the operational risks posed by centralized service providers and how that contradicts how the industry portrays itself.<\/p>\n<blockquote><p>&#8220;This market isn\u2019t so decentralized. Now, we see this industry populated by large, concentrated intermediaries, which often are an amalgam of services that typically are separated from each other in the rest of the securities markets.&#8221;<\/p><\/blockquote>\n<p>Similarly, the SEC Chair believes most crypto tokens are securities and would fall under the SEC's remit. Gensler said:<\/p>\n<blockquote><p>&#8220;Of the nearly 10,000 tokens in the crypto market, I believe the vast majority are securities.
