{"id":260701,"date":"2022-09-08T15:45:43","date_gmt":"2022-09-08T14:45:43","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=260701"},"modified":"2022-09-08T15:45:43","modified_gmt":"2022-09-08T14:45:43","slug":"coinbase-finances-tornado-cash-users-lawsuit-against-us-treasury-department","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/coinbase-finances-tornado-cash-users-lawsuit-against-us-treasury-department\/","title":{"rendered":"Coinbase finances Tornado Cash users&#8217; lawsuit against US Treasury Department"},"content":{"rendered":"<p>Coinbase is financing a lawsuit filed against the US Treasury Department by six users of sanctioned crypto protocol Tornado Cash, CNBC <a href=\"https:\/\/www.cnbc.com\/amp\/2022\/09\/08\/coinbase-bankrolls-suit-against-treasury-department-following-tornado-cash-sanctions.html\">reported<\/a> on Sept. 8.<\/p>\n<p>The lawsuit argued that the <a href=\"https:\/\/cryptoslate.com\/erik-voorhees-urges-makerdao-community-to-exit-usdc-holdings-after-tornado-cash-sanctions\/\">sanctions<\/a> were a violation of the plaintiffs' rights as guaranteed by the US constitution, adding that the authorities overstepped their authority in sanctioning a &#8220;decentralized, open-source software project&#8221; that &#8220;law-abiding Americans (use) to engage freely and privately in financial transactions.&#8221;<\/p>\n<p>Treasury Secretary Janet Yellen and OFAC Director Andrea Gacki were also defendants in the lawsuit.<\/p>\n<h2>Plaintiffs used protocol for legitimate purposes<\/h2>\n<p>The plaintiffs revealed they have some Ethereum (ETH) locked in Tornado Cash, which they can no longer access due to the US sanctions. They said they used the crypto mixer for legitimate purposes like donating to Ukraine and protecting their public identities.<\/p>\n<p>The lawsuit wants the court to vacate the sanctions imposed on Tornado Cash.<\/p>\n<p>The plaintiffs include two Coinbase employees, Tyler Almeida and Nate Welch, Prysmatic Labs co-founder Preston Van Loon and brother Joseph Van Loon, GridPlus engineer Kevin Vitale, and angel investor Alexander Fisher.<\/p>\n<h2>Coinbase's reason for sponsoring the lawsuit<\/h2>\n<p>Coinabase's CEO Brian Armstrong, in a Sept. 8 blog post, <a href=\"https:\/\/blog.coinbase.com\/defending-privacy-in-crypto-e09db33dece8\">said<\/a> the US sanctions would stifle innovations. Additionally, Armstrong noted that the &#8220;Treasury used a hammer instead of a scalpel&#8221; in restricting legitimate users' access to the protocol.<\/p>\n<p>The exchange's chief legal officer, Paul Grewal, said:<\/p>\n<blockquote><p>&#8220;The novel sanctions harmed innocent individuals and threatened the critical development of crypto privacy protocols.&#8221;<\/p><\/blockquote>\n<h2>The Tornado Cash sanction<\/h2>\n<p>The Tornado Cash sanction had drawn wide condemnation from the crypto community, who argued that the sanctions were inappropriate. However, US authorities <a href=\"https:\/\/cryptoslate.com\/us-vows-to-aggressively-pursue-crypto-mixers-following-tornado-cash-sanctions\/\">vowed<\/a> to pursue crypto mixers that criminals use to launder money aggressively.<\/p>\n<p>Coin Center, a non-profit organization, said it was preparing to challenge the sanctions in court.<\/p>\n<p>Meanwhile, since the sanction, Tornado Cash' <a href=\"https:\/\/cryptoslate.com\/coins\/tornado-cash\/\">TORN<\/a> token has shed 53% of its value in the last 30 days.
