{"id":250008,"date":"2022-07-25T14:00:34","date_gmt":"2022-07-25T13:00:34","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=250008"},"modified":"2022-07-25T14:08:03","modified_gmt":"2022-07-25T13:08:03","slug":"terra-celsius-hit-with-class-action-lawsuits-in-california-new-jersey","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/terra-celsius-hit-with-class-action-lawsuits-in-california-new-jersey\/","title":{"rendered":"Terra, Celsius hit with class action lawsuits in the US"},"content":{"rendered":"<p>A new class action lawsuit against TerraForm Labs and its CEO, Do Kwon, was <a href=\"https:\/\/www.businesswire.com\/news\/home\/20220724005041\/en\">filed<\/a> by Bragar Eagel & Squire, P.C. on July 24 in the state of California.<\/p>\n<p>Bragar Eagel & Squire, P.C. also slapped a <a href=\"https:\/\/www.businesswire.com\/news\/home\/20220724005039\/en\/CELSIUS-ALERT-Bragar-Eagel-Squire-P.C.-Announces-that-a-Class-Action-Lawsuit-Has-Been-Filed-Against-Celsius-Network-LLC-and-Other-Defendants-and-Encourages-Investors-to-Contact-the-Firm\/\">class action lawsuit<\/a> against Celsius Network, Alexander Mashinksy, and other firms and individuals connected o the crypto lender on July 24 in the state of New Jersey.<\/p>\n<p>The lawsuit was filed on behalf of investors who purchased Terra tokens like <a href=\"https:\/\/cryptoslate.com\/coins\/terrausd\/#:~:text=TerraUSD%20(USTC)%20%2D%20Price%2C%20Chart%2C%20Info%20%7C%20CryptoSlate&text=The%20global%20crypto%20market%20cap,ETH%20market%20dominance%20is%2018.2%25.\">UST<\/a>, <a href=\"https:\/\/cryptoslate.com\/coins\/terra-classic\/\">LUNA<\/a>, <a href=\"https:\/\/cryptoslate.com\/coins\/mirror-protocol\/\">MIR<\/a>, and others between May 20, 2021, and May 25, 2022.<\/p>\n<h2>Terraform accused of misleading investors<\/h2>\n<p>According to the filed complaint, Terraform Labs and other defendants violated the Exchange Act by deliberately misleading investors to purchase the Terra tokens at &#8220;artificially inflated prices&#8221; and using false statements to lure in unsuspecting investors.<\/p>\n<p>The lawsuit also claimed Terraform Labs violated the Securities Act by failing to register the Terra tokens as a security. It added that all the defendants violated the RICO Act by conducting the enterprise's affairs through a racketeering pattern.<\/p>\n<p>Other defendants in the case include bankrupt crypto hedge fund Three Arrows Capital, venture capital firm Jump Crypto, Nicholas Platias, and other connected businesses to Terra.<\/p>\n<h2>Terra facing two lawsuits<\/h2>\n<p>Meanwhile, a similar lawsuit was <a href=\"https:\/\/fingfx.thomsonreuters.com\/gfx\/legaldocs\/zdvxoenlzpx\/frankel-terraformclassaction--complaint.pdf\">filed<\/a> by Nick Patterson against Terra on July 17.<\/p>\n<p>Patterson alleged that Terra tokens were securities and that Terraform Labs failed to maintain Terra's ecosystem, which led to losses for retail investors.<\/p>\n<p>Patterson wants the court to declare Terra tokens as securities while adding that investors should be entitled to &#8220;punitive, consequential damages and restitution&#8221; relief from the defendants.<\/p>\n<p>The two lawsuits against Terra were filed in the Northern District of California.<\/p>\n<h2>Celsius lawsuit<\/h2>\n<p>Bragar Eagel filed the lawsuit on behalf of investors who purchased Celsius securities between February 9, 2018, and July 13, 2022.<\/p>\n<p>Like Terra's case, the lawsuit alleged that Celsius and other defendants violated the Exchange Act by tricking investors into purchasing Celsius Financial Products at inflated prices using false statements.<\/p>\n<p>Per the press statement, Celsius violated the Securities Act by selling unregistered &#8220;non-exempt securities.&#8221;<\/p>\n<p>Celsius Network <a href=\"https:\/\/cryptoslate.com\/celsius-officially-declares-bankruptcy-after-paying-down-defi-loans\/\">filed<\/a> for a Chapter 11 bankruptcy claim on July 14.
