Period. \u2b07\ufe0f<\/p>\n<p>&mdash; paulgrewal.eth (@iampaulgrewal) <a href=\"https:\/\/twitter.com\/iampaulgrewal\/status\/1550256812217098240?ref_src=twsrc%5Etfw\">July 21, 2022<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<h2>SEC classifies nine crypto assets as securities<\/h2>\n<p>The Securities and Exchange Commission (SEC), in a July 21 <a href=\"https:\/\/www.sec.gov\/litigation\/complaints\/2022\/comp-pr2022-127.pdf\">complaint<\/a> filed against <a href=\"https:\/\/cryptoslate.com\/ex-coinbase-manager-arrested-in-insider-trading-case-for-leaking-asset-listing-details\/\">former Coinbase product manager Ishan Wahi<\/a>, his brother Nikhil Wahi, and Sameer Ramani, classified nine crypto assets as securities.<\/p>\n<p>The affected crypto assets are Flexa Network's <a href=\"https:\/\/cryptoslate.com\/coins\/amp\/\">AMP<\/a>, Rally Network (<a href=\"https:\/\/cryptoslate.com\/coins\/rally\/\">RLY<\/a>), DerivaDEX (<a href=\"https:\/\/cryptoslate.com\/coins\/derivadao\/\">DDX<\/a>), <a href=\"https:\/\/cryptoslate.com\/coins\/xyo-network\/\">XYO<\/a>, Rari Governance Token (<a href=\"https:\/\/cryptoslate.com\/coins\/rari-governance-token\/\">RGT<\/a>), and Lichenstein Cryptoasset Exchange (<a href=\"https:\/\/cryptoslate.com\/coins\/lcx\/\">LCX<\/a>). Others are Power Ledger (<a href=\"https:\/\/cryptoslate.com\/coins\/powerledger\/\">POWR<\/a>), DFX Finance (DFX), and Kromatilka (KROM).<\/p>\n<p>According to the SEC complaint, a crypto asset is a security if it satisfies the Securities Act definition of an &#8220;investment contract.&#8221;<\/p>\n<p>The financial regulator claimed that the listed assets satisfy that definition because their investors invested in a joint enterprise with the intent of profiting from the efforts of others.<\/p>\n<h2>Coinbase disagrees with SEC<\/h2>\n<p>Paul Grewal said that seven of the nine assets classified by the SEC are listed on Coinbase. However, the exchange &#8220;100% disagrees with the SEC's decision to file these securities fraud charges.&#8221;<\/p>\n<p>According to Grewal, the crypto exchange has an SEC-reviewed process of analyzing crypto assets to determine whether they are securities and regulatory compliant.<\/p>\n<p>Grewal continued that the SEC's decision to &#8220;jump directly to litigation&#8221; highlighted the lack of regulatory clarity for &#8220;digital assets <em>securities<\/em>.&#8221; Grewal said:<\/p>\n<blockquote><p>&#8220;The SEC is relying on these types of one-off enforcement actions to try to bring all digital assets into its jurisdiction, even those assets that are <em class=\"ku\">not<\/em> securities.&#8221;<\/p><\/blockquote>\n<p>Meanwhile, Coinbase filed a <a href=\"https:\/\/assets.ctfassets.net\/c5bd0wqjc7v0\/5NRidtW8lvwVEfSHpndWQm\/78f95afa4f0ebaaefb303e1a4f172d03\/Coinbase_petition_for_SEC_rulemaking.pdf\">petition<\/a> on July 21 for the SEC to provide regulatory clarity on digital asset securities.<\/p>\n<h2>CFTC commissioner weighs in<\/h2>\n<p>Commodity Futures Trading Commission (CFTC) Commissioner Caroline Pham declared that the broad classification by the SEC is &#8220;a striking example of &#8216;regulation by enforcement.'&#8221;<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Read my statement on <a href=\"https:\/\/twitter.com\/hashtag\/SEC?src=hash&ref_src=twsrc%5Etfw\">#SEC<\/a> v.
