{"id":248012,"date":"2022-07-13T08:00:41","date_gmt":"2022-07-13T07:00:41","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=248012"},"modified":"2023-11-02T00:08:03","modified_gmt":"2023-11-02T00:08:03","slug":"microstrategys-michael-saylor-says-ethereum-is-security","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/microstrategys-michael-saylor-says-ethereum-is-security\/","title":{"rendered":"MicroStrategy\u2019s Michael Saylor says Ethereum is a security"},"content":{"rendered":"<p>In an interview with <a href=\"https:\/\/www.youtube.com\/watch?app=desktop&v=JGvdMWvyRAA&feature=youtu.be\">Altcoin Daily<\/a>, MicroStrategy's CEO Michael Saylor\u00a0said Ethereum (<a href=\"https:\/\/cryptoslate.com\/coins\/ethereum\/\">ETH<\/a>) is security.<\/p>\n<p>According to Saylor, the fact that Ethereum was first issued via an initial coin offering proves it is not a commodity.<\/p>\n<blockquote><p>&#8220;There's a management team. There was a pre-mine. There's a hard fork. There are continual hard forks.&#8221;<\/p><\/blockquote>\n<p>He also talked about Ethereum's difficulty bomb and how it keeps getting <a href=\"https:\/\/cryptoslate.com\/what-does-the-gray-glacier-upgrade-mean-for-the-ethereum-merge\/\">postponed<\/a> every six months, which serves to prove the asset is a security.<\/p>\n<p>If the Ethereum difficulty bomb went off, it would disincentivize miners and mark the network's full transition into a proof of stake network.<\/p>\n<h2>Michael Saylor classifies most crypto assets as securities<\/h2>\n<p>In Saylor's opinion, a cryptocurrency can only be a commodity if there is no issuer and no one is making any decisions on the network.<\/p>\n<p>Saylor said,<\/p>\n<blockquote><p>&#8220;If you look at most of these cryptos, where they have hard fork after hard fork after hard fork, the problem with a hard fork is changing the protocol means that some development team is making a decision, and if you can change the protocol in a material way, you can change the monetary protocol. A hard fork can change the issuance pattern, or it can change the value of something. So that makes an investment contract under securities law.&#8221;<\/p><\/blockquote>\n<p>Saylor believes the ability of Ethereum to change is also its problem as far as securities law is concerned. According to him, people want a decentralized protocol like Bitcoin that can't be changed.<\/p>\n<p>Meanwhile, he admitted that securities have their use. But there should be &#8220;full and fair disclosures&#8221; about these tokens.<\/p>\n<p>Additionally, he pointed to the recent <a href=\"https:\/\/www.forbes.com\/sites\/mariagraciasantillanalinares\/2022\/06\/27\/sec-chairman-gary-gensler-implies-that-ether-is-a-security-and-falls-under-his-jurisdiction\/amp\/\">statement<\/a> by the Securities and Exchange Commission (SEC) that any cryptocurrency that generates staking yields is security.<\/p>\n<p>Saylor's statement is coming on the heels of a lawsuit against Solana (<a href=\"https:\/\/cryptoslate.com\/coins\/solana\/\">SOL<\/a>) about being security.<\/p>\n<h2>Crypto community disagrees<\/h2>\n<p>Many in the crypto community don't agree with this view. Several podcasters have pointed out that even SEC chairman Gary Gensler hasn't described Ethereum as a security.<\/p>\n<p>George at <a href=\"https:\/\/www.youtube.com\/watch?v=1aOfQgTOmg0\"><span class=\"s4\">CryptosRUs<\/span><\/a> pointed out that even Bitcoin has had upgrades, including the SegWit upgrade, which was part of the reasons for the Bitcoin Cash hard fork.<\/p>\n<p>Furthermore, Senators Kirsten Gillibrand and Cynthia Lummis <a href=\"https:\/\/cryptoslate.com\/proposed-gillibrand-lummis-crypto-bill-uploaded-to-github-for-recommendations\/\">proposed<\/a> a crypto bill that specifically classified Bitcoin (<a href=\"https:\/\/cryptoslate.com\/coins\/bitcoin\/\">BTC<\/a>) and Ethereum as commodities.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In an interview with Altcoin Daily, MicroStrategy&#8217;s CEO Michael Saylor\u00a0said Ethereum (ETH) is security.
