{"id":235619,"date":"2022-05-03T17:00:53","date_gmt":"2022-05-03T16:00:53","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=235619"},"modified":"2022-05-03T13:57:37","modified_gmt":"2022-05-03T12:57:37","slug":"dfinity-is-suing-meta-over-logo","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/dfinity-is-suing-meta-over-logo\/","title":{"rendered":"Dfinity is suing Meta over the use of \u201cits logo\u201d"},"content":{"rendered":"<p style=\"font-weight: 400;\"><a href=\"https:\/\/cryptoslate.com\/companies\/dfinity\/\"><span style=\"font-weight: 400;\">Dfinity<\/span><\/a><span style=\"font-weight: 400;\"> Foundation, the developer of <\/span><a href=\"https:\/\/cryptoslate.com\/coins\/internet-computer\/\"><span style=\"font-weight: 400;\">Internet Computer Protocol<\/span><\/a><span style=\"font-weight: 400;\"> (ICP), has dragged Facebook\u2019s parent company, Meta, to court over its use of the infinity symbol as its logo.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The lawsuit, filed in California, has Dfinity claiming that Meta uses the logo for the same reason it chose to register it.<\/span><\/p>\n<h2><b>Dfinity registered the logo before Meta<\/b><\/h2>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Dfinity registered the logo in 2018 at the United States Patent and Trademark Office for decentralized platforms and blockchain technology services. This is similar to Meta, which after <\/span><a href=\"https:\/\/cryptoslate.com\/facebook-to-allow-crypto-ads-after-meta-rebrand\/\"><span style=\"font-weight: 400;\">rebranding<\/span><\/a><span style=\"font-weight: 400;\"> from Facebook, revealed its Metaverse aspirations.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Dfinity, thus, claims that Meta is using the logo to attract the same set of users that it is targeting.<\/span><\/p>\n<p>The non-profit foundation claimed that it has been using the logo since 2017, whereas Meta didn\u2019t register it until March 2022. It also noted that it didn\u2019t claim the color palette as a feature of the mark.<\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Therefore, it doesn\u2019t matter that there are color variations between its logo and that of Meta. It claims that it has ownership rights on all variations of the logo.<\/span><\/p>\n<h2><b>Says Meta\u2019s logo is harmful to its reputation<\/b><\/h2>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The details of the lawsuit first became public through Trademark attorney Josh Gorben, who posted it on Twitter. A part of the lawsuit states that Dfinity believes Meta\u2019s logo use might harm its reputation.<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Meta Platforms (Facebook) is being sued over its logo.<\/p>\n<p>A Swiss non-profit that develops blockchain technology (Dfinity), has filed a lawsuit claiming that Meta&#39;s new logo is too similar to its own.<\/p>\n<p>Apparently, an infinity logo is all the rage in Web3.<a href=\"https:\/\/twitter.com\/hashtag\/meta?src=hash&ref_src=twsrc%5Etfw\">#meta<\/a> <a href=\"https:\/\/twitter.com\/hashtag\/Facebook?src=hash&ref_src=twsrc%5Etfw\">#Facebook<\/a> <a href=\"https:\/\/twitter.com\/hashtag\/Web3?src=hash&ref_src=twsrc%5Etfw\">#Web3<\/a> <a href=\"https:\/\/t.co\/4Ay4a12uKy\">pic.twitter.com\/4Ay4a12uKy<\/a><\/p>\n<p>&mdash; Josh Gerben (@JoshGerben) <a href=\"https:\/\/twitter.com\/JoshGerben\/status\/1521199324507615232?ref_src=twsrc%5Etfw\">May 2, 2022<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<blockquote>\n<p style=\"font-weight: 400;\"><strong>&#8220;Dfinity would be severely harmed in its development of the Internet Computer and its ability to attract users if they were to associate Dfinity with Meta\u2019s sordid online privacy history.&#8221;<\/strong><\/p>\n<\/blockquote>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Dfinity also claims that Meta was aware of its use of the mark and still proceeded with obtaining registration.\u00a0<\/span><\/p>\n<blockquote>\n<p style=\"font-weight: 400;\"><strong>&#8220;Meta chose to proceed with its application to obtain registration in some of the same or similar areas in which Dfinity has already obtained registration for its mark.&#8221;<\/strong><\/p>\n<\/blockquote>\n<h2><b>Dfinity and Meta share logo with others<\/b><\/h2>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Furthermore, there are similarities between the areas where both entities sought registration. When defining \u201cGood and Services,\u201d Meta used the same description as Dfinity in its trademark application.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">The foundation now wants the court to stop Meta from using the logo and wants to get damages for what it called \u201cserious reputational harm.\u201d\u00a0<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">It is hard to determine the chances of Dfinity winning the lawsuit as several brands, such as Infinity Speakers, Microsoft Visual Studio, Infinity Wealth Management, etc., also use the symbol for their logo.<\/span><\/p>\n<p style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Dfinity shot into the limelight after the <\/span><a href=\"https:\/\/cryptoslate.com\/exclusive-dfinity-founder-shoots-down-all-rugpull-allegations-around-internet-computer-icp-tokens\/\"><span style=\"font-weight: 400;\">collapse<\/span><\/a><span style=\"font-weight: 400;\"> of its ICP token.
