{"id":228210,"date":"2022-03-29T13:45:45","date_gmt":"2022-03-29T12:45:45","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=228210"},"modified":"2022-03-29T13:44:48","modified_gmt":"2022-03-29T12:44:48","slug":"u-s-treasury-wants-to-include-crypto-in-foreign-accounts-reporting-rules","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/u-s-treasury-wants-to-include-crypto-in-foreign-accounts-reporting-rules\/","title":{"rendered":"U.S. Treasury wants to include crypto in foreign accounts reporting rules"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">A new proposal published by the U.S. Treasury suggests that cryptocurrencies such as Bitcoin and Ethereum should be added to the Internal Revenue Service\u2019s (IRS) rules for reporting taxpayers\u2019 offshore accounts.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A recently published <\/span><a href=\"https:\/\/home.treasury.gov\/system\/files\/131\/General-Explanations-FY2023.pdf\"><span style=\"font-weight: 400;\">document<\/span><\/a><span style=\"font-weight: 400;\">, titled \u201cGeneral Explanations of the Administration's Fiscal Year 2023 Revenue Proposals,\u201d explains that Section 6038D of the Internal Revenue Code \u201crequires any individual that holds an interest in one or more specified foreign financial assets with an aggregate value of at least $50,000\u2026to attach a Statement with required information to the individual\u2019s tax return.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, foreign accounts holding funds in the form of cryptocurrencies have been exempt from the offshore reporting rules so far. So in order to bring digital assets in line with traditional funds, the Treasury is now proposing to change this law.<\/span><\/p>\n<blockquote><p><strong>\u201cThe proposal would amend section 6038D(b) of the Code to require reporting with respect to a new third category of asset,\u201d the Treasury explained. \u201cThe new third category would be any account that holds digital assets maintained by a foreign digital asset exchange or other foreign digital asset service provider.\u201d<\/strong><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">If the proposal comes into force, all American taxpayers that \u201chold an aggregate value of all three categories of assets in excess of $50,000\u201d will have to report their accounts to the IRS, meaning that the value of digital assets will have to be added to the total sum.<\/span><\/p>\n<h2>Reasons for change<\/h2>\n<p><span style=\"font-weight: 400;\">Explaining its reasoning for the change, the Treasury noted that tax compliance and enforcement with respect to digital assets \u201cis a rapidly growing problem.\u201d Further, since the crypto industry is fully digital, taxpayers are able to execute transactions with offshore crypto exchanges and wallets without even leaving the U.S.<\/span><\/p>\n<blockquote><p><strong>\u201cThe global nature of the digital asset market offers opportunities for U.S. taxpayers to conceal assets and taxable income by using offshore digital asset exchanges and wallet providers. U.S. taxpayers also attempt to avoid U.S. tax reporting by creating entities through which they can act,\u201d the document explained.<\/strong><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">The proposal also implies that taxpaying crypto enthusiasts will be \u201csubject to significant penalties\u201d if they fail to comply with the new rules if (or when) they come into effect.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Notably, the Treasury\u2019s initiative is largely in tune with the recently submitted Budget proposal for the 2023 fiscal year which revealed that President Biden is looking to generate more tax revenue by adopting <\/span><a href=\"https:\/\/cryptoslate.com\/president-biden-eyes-5-billion-revenue-from-crypto-in-2023\/\"><span style=\"font-weight: 400;\">new crypto tax reporting rules<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A new proposal published by the U.S. Treasury suggests that cryptocurrencies such as Bitcoin and Ethereum should be added to the Internal Revenue Service\u2019s (IRS) rules for reporting taxpayers\u2019 offshore accounts.
