(@FilanLaw) <a href=\"https:\/\/twitter.com\/FilanLaw\/status\/1435615232563503116?ref_src=twsrc%5Etfw\">September 8, 2021<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p><span style=\"font-weight: 400;\">Filan also shared the regulator\u2019s recent <\/span><a href=\"https:\/\/twitter.com\/FilanLaw\/status\/1435738350804164613\"><span style=\"font-weight: 400;\">filing<\/span><\/a><span style=\"font-weight: 400;\"> on Twitter, in which the agency opposed answering interrogatories regarding the application of the Howey test for determining the security status of XRP.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As for Coinbase, the SEC allegedly failed to communicate any details regarding the product\u2019s assessment, for which they used \u201cthe prism of decades-old Supreme Court cases called Howey and Reves.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe SEC told us they consider Lend to involve a security, but wouldn\u2019t say why or how they\u2019d reached that conclusion,\u201d according to the exchange.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe SEC won\u2019t share the assessment itself, only the fact that they have done it,\u201d explained Coinbase\u2019s Chief Legal Officer Paul Grewal in the company\u2019s official post on Medium.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\"><strong>Not a legal advice<\/strong>\u00a0<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The billionaire Mark Cuban, was among those who joined the conversation on Twitter, advising the offensive approach.\u00a0<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Brian, this is &quot;Regulation via Litigation&quot;.
