{"id":196359,"date":"2021-08-07T08:00:39","date_gmt":"2021-08-07T07:00:39","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=196359"},"modified":"2021-08-07T11:29:44","modified_gmt":"2021-08-07T10:29:44","slug":"ripple-xrp-founder-slams-us-sec-over-its-crypto-knowledge","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/ripple-xrp-founder-slams-us-sec-over-its-crypto-knowledge\/","title":{"rendered":"Ripple (XRP) founder slams US SEC over its crypto &#8216;clarity&#8217;"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">Earlier this week at the <\/span><a href=\"https:\/\/www.aspensecurityforum.org\/asf-2021-video\"><span style=\"font-weight: 400;\">Aspen Security Forum<\/span><\/a><span style=\"font-weight: 400;\">, an annual three-day conference for global leaders to discuss some of the key national security issues, <\/span><a href=\"https:\/\/cryptoslate.com\/xrp-volumes-nearly-doubled-in-q2-2021-ripple-report-shows\/\"><span style=\"font-weight: 400;\">Ripple<\/span><\/a><span style=\"font-weight: 400;\">\u2019s CEO Brad Garlinghouse <\/span><a href=\"https:\/\/www.youtube.com\/watch?v=nMbg39uU2lA&t=1313s\"><span style=\"font-weight: 400;\">addressed<\/span><\/a><span style=\"font-weight: 400;\"> the lack of clarity surrounding the crypto industry and its regulation in the US.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Garlinghouse, who commented on the Security and Exchange Commission (SEC) Chair Gary Gensler\u2019s <\/span><a href=\"https:\/\/www.youtube.com\/watch?v=tusQLLCgrDs&t=3335s\"><span style=\"font-weight: 400;\">discussion<\/span><\/a><span style=\"font-weight: 400;\"> on the matter, which took part earlier in the conference, is personally a <\/span><a href=\"https:\/\/cryptoslate.com\/ripple-xrp-granted-access-to-binance-documents-for-sec-case\/\"><span style=\"font-weight: 400;\">defendant<\/span><\/a><span style=\"font-weight: 400;\"> in the ongoing court case filed by the agency, alleging that Ripple\u2019s sale of <\/span><a href=\"https:\/\/cryptoslate.com\/coins\/xrp\/\"><span style=\"font-weight: 400;\">XRP<\/span><\/a><span style=\"font-weight: 400;\"> was unregistered security offering worth more than $1.38 billion.<\/span><\/p>\n<h2><strong>Elephant in the room<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">\u201cIn my judgment, if you\u2019re dealing with an alcoholic that doesn\u2019t want to admit they have an alcohol problem, to say that we have certainty, we have clarity, is like the alcoholic saying \u2018I don\u2019t have a problem\u2019. This is the elephant in the room,\u201d said Garlinghouse.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cFor years I think the crypto industry has asked for that clarity, and yesterday we heard \u2018it is clear,\u201d added Ripple\u2019s CEO, mentioning a recent paradox when two SEC commissioners <\/span><a href=\"https:\/\/cryptoslate.com\/ripple-transfers-60-million-xrp-as-lawsuit-crawls-on\/\"><span style=\"font-weight: 400;\">stated<\/span><\/a><span style=\"font-weight: 400;\"> \u201ca decided lack of clarity for market participants around the application of the securities laws to digital assets and their trading.'\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">He reflected on other G20 markets like the UK, Japan, Switzerland, and Singapore \u201cwho have been proactive and engaged\u201d and pointed out that addressing the regulatory clarity issue is a prerequisite for the US if it wants to be a leader in the crypto space.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cBeing a company based here in the US, I want to see the US thrive in this area. I want to work with the US government to provide clarity, to provide certainty. But trying to provide that clarity through enforcement action is not, I think, the right answer,\u201d said Garlinghouse, whose company kept <\/span><a href=\"https:\/\/cryptoslate.com\/xrp-jumps-19-as-ripple-announces-odl-corridor-in-crypto-friendly-japan\/\"><span style=\"font-weight: 400;\">expanding<\/span><\/a><span style=\"font-weight: 400;\"> abroad, while its advancement in the homefront was halted by the lawsuit.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\"><strong>Regulation through litigation<\/strong>\u00a0<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">When asked about \u201cthe timing of clarity on crypto regulation,\u201d Gensler answered that the agency has been \u201cawfully clear on a bunch of this stuff,\u201d adding that the SEC has brought 75 cases in the sector.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Later in the conference, Garlinghouse took the opportunity to point out that 37 of those cases did not involve the sale of digital assets, and another 37 cases were initial coin offerings (ICOs), many of which were frauds.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cOnly one of the 75 involves a digital asset outside of an ICO.
