{"id":196218,"date":"2021-08-04T23:00:41","date_gmt":"2021-08-04T22:00:41","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=196218"},"modified":"2021-08-04T14:57:33","modified_gmt":"2021-08-04T13:57:33","slug":"ripple-xrp-granted-access-to-binance-documents-for-sec-case","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/ripple-xrp-granted-access-to-binance-documents-for-sec-case\/","title":{"rendered":"Ripple (XRP) granted access to Binance documents for SEC case"},"content":{"rendered":"<p><a href=\"https:\/\/cryptoslate.com\/xrp-volumes-nearly-doubled-in-q2-2021-ripple-report-shows\/\"><span style=\"font-weight: 400;\">Ripple<\/span><\/a><span style=\"font-weight: 400;\">\u2019s lawsuit with the US Securities and Exchange Commission (SEC) involved one of the largest crypto exchanges in the case discovery as Brad Garlinghouse\u2019s motion to obtain <\/span><a href=\"https:\/\/cryptoslate.com\/binance-looking-to-setup-physical-headquarters-following-regulatory-backlash\/\"><span style=\"font-weight: 400;\">Binance<\/span><\/a><span style=\"font-weight: 400;\">\u00a0documents from the Cayman Islands has been granted by the court.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Garlinghouse\u2019s motion came as a part of the <\/span><a href=\"https:\/\/cryptoslate.com\/sec-vs-ripple-update-agreement-to-reschedule-deposition-on-ethereum-and-xrp\/\"><span style=\"font-weight: 400;\">ongoing<\/span><\/a><span style=\"font-weight: 400;\"> court case filed by the SEC, alleging that Ripple\u2019s sale of <\/span><a href=\"https:\/\/cryptoslate.com\/coins\/xrp\/\"><span style=\"font-weight: 400;\">XRP<\/span><\/a><span style=\"font-weight: 400;\"> was an unregistered security offering worth more than $1.38 billion.<\/span><\/p>\n<h2><strong>Judge grants request for Binance documents<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">According to the SEC\u2019s amended complaint, Ripple CEO Garlinghouse sold more than 357 million units of XRP to \u201cpublic investors in the market,\u201d specifying the offers and sales were made on \u201cworldwide\u201d digital asset trading platforms as XRP was sold to investors \u201call over the world,\u201d while violating Section 5 of the Securities Act of 1933.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Earlier this week, Garlinghouse\u2019s Counsel <\/span><a href=\"https:\/\/www.courtlistener.com\/docket\/19857399\/274\/securities-and-exchange-commission-v-ripple-labs-inc\/\"><span style=\"font-weight: 400;\">filed<\/span><\/a><span style=\"font-weight: 400;\"> a motion for international discovery, appealing to obtain Binance\u2019s Cayman Island documents.<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\"><a href=\"https:\/\/twitter.com\/hashtag\/XRPCommunity?src=hash&ref_src=twsrc%5Etfw\">#XRPCommunity<\/a> <a href=\"https:\/\/twitter.com\/hashtag\/SECGov?src=hash&ref_src=twsrc%5Etfw\">#SECGov<\/a> v. <a href=\"https:\/\/twitter.com\/hashtag\/Ripple?src=hash&ref_src=twsrc%5Etfw\">#Ripple<\/a> <a href=\"https:\/\/twitter.com\/hashtag\/XRP?src=hash&ref_src=twsrc%5Etfw\">#XRP<\/a> Brad Garlinghouse files a second Motion to Obtain International Discovery. (@FilanLaw) <a href=\"https:\/\/twitter.com\/FilanLaw\/status\/1422241771073986560?ref_src=twsrc%5Etfw\">August 2, 2021<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p><span style=\"font-weight: 400;\">\u201cMr. Garlinghouse seeks foreign discovery on the basis of his good faith belief that the listed entity possesses unique documents and information concerning this case, and specifically <\/span><span style=\"font-weight: 400;\">concerning the process by which transactions in XRP were allegedly conducted by Mr. Garlinghouse <\/span><span style=\"font-weight: 400;\">on foreign digital asset trading platforms were conducted,\u201d read the memorandum <\/span><a href=\"https:\/\/www.courtlistener.com\/docket\/19857399\/275\/securities-and-exchange-commission-v-ripple-labs-inc\/\"><span style=\"font-weight: 400;\">filed<\/span><\/a><span style=\"font-weight: 400;\"> in support of Garlinghouse\u2019s motion.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the memorandum, the securities act only applies to domestic sales and offers, thus contrary to SEC\u2019s claims of global violation, it implies the regulator can only prosecute services in the US, while the majority of \u201coverwhelming\u201d XRP sales were conducted abroad.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe Supreme Court has held that Section 5 of the Securities Act of 1933, which the SEC alleges Mr. Garlinghouse violated, applies only to domestic sales and offers of securities.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to defense lawyer James K.
