{"id":195299,"date":"2021-07-20T17:00:25","date_gmt":"2021-07-20T16:00:25","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=195299"},"modified":"2021-07-20T08:49:47","modified_gmt":"2021-07-20T07:49:47","slug":"crypto-bank-blockfi-faces-regulatory-block-in-new-jersey","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/crypto-bank-blockfi-faces-regulatory-block-in-new-jersey\/","title":{"rendered":"Crypto bank BlockFi faces regulatory block in New Jersey"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">The New Jersey Bureau of Securities has filed a cease and desist order against cryptocurrency lending company <a href=\"https:\/\/cryptoslate.com\/companies\/blockfi\/\">BlockFi<\/a>, prohibiting it from accepting new clients for the firm\u2019s Interest Account service in the corresponding jurisdiction.<\/span><\/p>\n<h2>No BlockFi in New Jersey<\/h2>\n<p><a href=\"https:\/\/www.forbes.com\/sites\/stevenehrlich\/2021\/07\/19\/new-jersey-attorney-general-prepares-cease-and-desist-order-against-multi-billion-dollar-bitcoin-financial-services-platform\/\"><i><span style=\"font-weight: 400;\">Forbes<\/span><\/i><\/a><span style=\"font-weight: 400;\"> initially broke the news earlier today, citing a draft press release from the New Jersey Office of the Attorney General. The document itself suggested that BlockFi has broken some of the securities laws.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cOur rules are simple: if you sell securities in New Jersey, you need to comply with New Jersey\u2019s securities laws. No one gets a free pass simply because they\u2019re operating in the fast-evolving cryptocurrency market. Our Bureau of Securities will be monitoring this issue closely as we work to protect investors,\u201d\u00a0 said Acting Attorney General Andrew J. Bruck in the release.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This was later confirmed by BlockFi CEO Zac Prince on Twitter.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cLate Monday evening BlockFi received an order from the New Jersey Bureau of Securities regarding BlockFi Interest Account (BIA) operations in the State of New Jersey,\u201d Prince tweeted, adding, \u201cWe remain fully operational for our existing clients in New Jersey. The order calls for BlockFi to stop accepting new BIA clients residing in New Jersey beginning July 22, 2021.\u201d<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">BlockFi is engaged in an ongoing dialogue with regulators to help them understand our products, which we believe are lawful and appropriate for crypto market participants. BIA is not a security, and we therefore disagree with the action by the New Jersey Bureau of Securities.<\/p>\n<p>&mdash; Zac Prince (@BlockFiZac) <a href=\"https:\/\/twitter.com\/BlockFiZac\/status\/1417316836157296643?ref_src=twsrc%5Etfw\">July 20, 2021<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p><span style=\"font-weight: 400;\">He added that BlockFi is currently \u201cengaged in an ongoing dialogue with regulators to help them understand our products, which we believe are lawful and appropriate for crypto market participants.\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Prince also argued that BlockFi Interest Account is not a security and, as such, the company disagrees \u201cwith the action by the New Jersey Bureau of Securities.\u201d<\/span><\/p>\n<h2><strong>Troubles come after a massive funding round<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">As CryptoSlate reported, BlockFi has recently reached a $3 billion valuation after it <\/span><a href=\"https:\/\/cryptoslate.com\/crypto-bank-blockfi-reaches-3-billion-valuation-after-350m-raise\/\"><span style=\"font-weight: 400;\">raised over $350 million<\/span><\/a><span style=\"font-weight: 400;\"> in a Series D funding round in March. The company is one the most prominent \u201ccrypto banks\u201d in the space, allowing its customers to earn high yields of 6-8.6% on their cryptocurrencies, including stablecoins.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">At press time, it is not entirely clear whether the cease and desist refers to BlockFi\u2019s operations in their entirety or only to some of the assets the firm supports.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Notably, the U.S. Securities and Exchange Commission stated that Bitcoin and Ethereum, for example, are not considered securities by the regulator.
