{"id":193432,"date":"2021-06-23T05:00:33","date_gmt":"2021-06-23T04:00:33","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=193432"},"modified":"2021-06-22T20:15:02","modified_gmt":"2021-06-22T19:15:02","slug":"indians-could-be-charged-an-extra-2-tax-on-bitcoin-crypto-purchased-abroad","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/indians-could-be-charged-an-extra-2-tax-on-bitcoin-crypto-purchased-abroad\/","title":{"rendered":"Indians could be charged an extra 2% tax on Bitcoin and crypto &#8216;purchased abroad&#8217;"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">Bitcoin (<\/span><a href=\"https:\/\/cryptoslate.com\/coins\/bitcoin\/\"><span style=\"font-weight: 400;\">BTC<\/span><\/a><span style=\"font-weight: 400;\">) and other cryptocurrencies bought from exchanges outside the country could cost Indian investors additional tax, while the tax department is looking into whether crypto falls subject to the 2% equalization levy, <\/span><a href=\"https:\/\/economictimes.indiatimes.com\/markets\/cryptocurrency\/equalisation-levy-could-make-life-more-taxing-for-cryptocurrency-buyers\/articleshow\/83733902.cms\"><span style=\"font-weight: 400;\">reported<\/span><\/a><span style=\"font-weight: 400;\"> the <\/span><i><span style=\"font-weight: 400;\">Economic Times<\/span><\/i><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h2><strong>Google tax<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">Services provided in India by overseas e-commerce companies are subject to the equalization levy, also colloquially called the &#8220;Google tax&#8221; but the experts are still uncertain how it's applicable to crypto.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#8220;The way the new equalization levy is worded and defined, it appears that it will also be applicable on cryptocurrency bought from an exchange not based in India,&#8221; tax expert and founder of Transaction Square tax-advisory company, Girish Vanvari, told Economic Times, adding:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cIn the absence of any guidelines on the treatment of crypto assets, there is ambiguity in how these would be treated under the tax laws and Foreign Exchange Management Act.&#8221;\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to his interpretation, the levy, which is usually meant for foreign corporations, would apply to the selling prices, meaning exchanges might add it to the cost of cryptos.<\/span><\/p>\n<h2><strong>Missing guidelines<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">In 2020 India expanded the scope of the equalization levy to cover \u201ce-commerce supplies or services,\u201d not exempting business-to-customer transactions.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The 2021 Finance Bill clarifies that the equalization levy now includes online marketplaces that function entirely as intermediaries between buyers and sellers as it clarified the terms not defined in Finance Act 2016, which created the levy, nor in Finance Act 2020 that expanded it.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The country is yet to classify cryptocurrencies and the absence of a regulatory framework makes it more difficult to understand the implications of the equalization levy.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Legislators in India were sending mixed signals regarding Bitcoin recently, ranging from <\/span><a href=\"https:\/\/cryptoslate.com\/bitcoin-drops-10-after-indian-government-proposes-new-crypto-ban\/\"><span style=\"font-weight: 400;\">banning<\/span><\/a><span style=\"font-weight: 400;\"> to <\/span><a href=\"https:\/\/cryptoslate.com\/india-could-soon-classify-bitcoin-as-a-regulated-asset\/\"><span style=\"font-weight: 400;\">classifying<\/span><\/a><span style=\"font-weight: 400;\"> it as an asset class.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Will the tax law speed up the process or have they found a way to bypass the issue altogether until they make up their mind?\u00a0\u00a0<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Bitcoin (BTC) and other cryptocurrencies bought from exchanges outside the country could cost Indian investors additional tax, while the tax department is looking into whether crypto falls subject to the 2% equalization levy, reported the Economic Times.
