{"id":113878,"date":"2019-09-18T00:50:51","date_gmt":"2019-09-18T00:50:51","guid":{"rendered":"https:\/\/cryptoslate.com\/?p=113878"},"modified":"2019-11-07T02:51:42","modified_gmt":"2019-11-07T02:51:42","slug":"vaneck-solidx-withdraws-bitcoin-etf-sec","status":"publish","type":"post","link":"https:\/\/cryptoslate.com\/vaneck-solidx-withdraws-bitcoin-etf-sec\/","title":{"rendered":"VanEck-SolidX withdraws Bitcoin ETF proposal from SEC&#8217;s consideration"},"content":{"rendered":"<p>The VanEck-SolidX <a href=\"http:\/\/cryptoslate.com\/coins\/bitcoin\">Bitcoin<\/a> ETF proposal was withdrawn\u2014again\u2014from the SEC\u2019s consideration prior to an October decision.<\/p>\n<h2>Primer on VanEck-SolidX Bitcoin Shares<\/h2>\n<p>VanEck-SolidX first <a href=\"https:\/\/www.sec.gov\/comments\/sr-cboebzx-2019-004\/srcboebzx2019004.htm\">submitted<\/a> its proposal to list and trade shares of the \u201cVanEck SolidX Bitcoin Trust\u201d under commodity-based trust rules with the Securities Exchange Commission. Securities backed with gold or crude oil held in trust, for example, would fall under these rules.<\/p>\n<h2>Proposal withdrawn, again<\/h2>\n<p>Today, a document was filed <a href=\"https:\/\/www.sec.gov\/rules\/sro\/cboebzx\/2019\/34-86995.pdf\">showing<\/a> VanEck-SolidX withdrew the proposal to list and trade shares of its Bitcoin-backed trust from the SEC\u2019s consideration\u2014<a href=\"https:\/\/cryptoslate.com\/van-eck-crypto-investors-return-gold-solidx-btc-etf-withdrawn\/\">once again<\/a>. The withdrawal comes after the SEC <a href=\"https:\/\/cryptoslate.com\/vaneck-solidx-bitcoin-etf-delayed-by-sec-for-public-comments\/\">delayed<\/a> the decision on the BTC ETF on Aug. 12.<\/p>\n<p>The proposal was also <a href=\"https:\/\/cryptoslate.com\/van-eck-crypto-investors-return-gold-solidx-btc-etf-withdrawn\/\">withdrawn<\/a> in January, and then <a href=\"https:\/\/cryptoslate.com\/cboe-resubmits-van-eck-solidx-bitcoin-etf-after-week-long-withdrawal\/\">resubmitted<\/a> it for consideration a week later, when the U.S. federal government was <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2019-01-10\/what-you-need-to-know-about-u-s-government-shutdown-quicktake\">shutdown<\/a>.<\/p>\n<p>Previously, the Commission expressed concerns over whether the ETF can meet <a href=\"https:\/\/legcounsel.house.gov\/Comps\/Securities%20Exchange%20Act%20Of%201934.pdf\">federal guidelines<\/a> for securities exchanges. Many of these concerns pertain to the liquidity, custody, and transparency of the ETF, along with concerns over manipulation in the crypto markets.<\/p>\n<h2>Primary concerns from the Securities Exchange Commission<\/h2>\n<p>More specifically, the Commission <a href=\"https:\/\/www.sec.gov\/rules\/sro\/cboebzx\/2019\/34-85119.pdf\">emphasized<\/a> that Cboe and the Bitcoin trust must demonstrate that the underlying Bitcoin markets are \u201cregulated markets\u201d of \u201csignificant size,\u201d among a few other secondary factors.<\/p>\n<p>Meanwhile, VanEck and SolidX maintain that the Bitcoin markets are fundamentally resistant to price manipulation when controlling for wash trading, in line with research <a href=\"https:\/\/cryptoslate.com\/bitwise-bitcoin-etf-delayed-five-weeks\/\">conducted by Bitwise<\/a>. When analyzed appropriately the markets already satisfy the Commission\u2019s criteria, so now it\u2019s a matter of proving that VanEck-SolidX\u2019s surveillance and controls around its trust are adequate.<\/p>\n<p>Among the ETFs pending include proposals from <a href=\"https:\/\/cryptoslate.com\/companies\/bitwise-asset-management\/\">Bitwise<\/a>, Winklevoss, and Wilshire Phoenix. These ETFs will see decisions by the end of September through mid-October.
