{"id":7747,"date":"2022-08-03T15:37:59","date_gmt":"2022-08-03T15:37:59","guid":{"rendered":"http:\/\/ci02a7d50a00002662"},"modified":"2022-08-03T15:37:59","modified_gmt":"2022-08-03T15:37:59","slug":"senate-to-classify-bitcoin-as-digital-commodity","status":"publish","type":"post","link":"https:\/\/bitcoinmagazine.com\/legal\/senate-to-classify-bitcoin-as-digital-commodity","title":{"rendered":"Senate Bill Classifying Bitcoin As A Digital Commodity To Be Introduced Today: Report"},"content":{"rendered":"<div id=\"bsf_rt_marker\"><\/div><ul>\n<li>A new bill classifying bitcoin as a digital commodity could be introduced today. <\/li>\n<li>This move would empower the current watchdog of derivatives and future markets, the CFTC, to gain regulatory jurisdiction over bitcoin.<\/li>\n<li>The bill seeks to expand on previous definitions in the bitcoin ecosystem while also excluding securities from being digital commodities. <\/li>\n<\/ul>\n<p>Leaders of the Senate Agriculture Committee (SAC) are planning to introduce a bill that would classify bitcoin as a digital commodity, according to a report from the <a href=\"https:\/\/www.wsj.com\/articles\/senate-plan-would-put-bitcoin-ether-under-commodity-regulators-watch-11659499261\" target=\"_blank\" rel=\"noopener\">Wall Street Journal<\/a>.<\/p>\n<p>The category of digital commodity is fairly new. Currently the Commodity Futures Trading Commission (CFTC) oversees the regulation for derivatives of commodities, rather than the underlying commodity itself. This bill seeks to empower the CFTC to regulate spot markets for digital commodities which means the regulator would be given the ability to regulate the underlying asset itself. <\/p>\n<p>The bill will also exclude securities from simultaneously being labeled a digital commodity. Therefore, any and all cryptocurrencies labeled as a security would fall under the jurisdiction of the Securities and Exchange Commission (SEC) rather than the CFTC. <\/p>\n<p>In fact, the SEC has already made <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2022-07-28\/sec-chair-gensler-hardens-line-on-crypto-exchange-registration\" target=\"_blank\" rel=\"noopener\">multiple appeals<\/a> to cryptocurrency exchanges suggesting they register with the SEC as security exchanges. This action would place exchanges in the same category as other securities trading platforms like the New York Stock Exchange. <\/p>\n<p>Additionally, the bill will <a href=\"https:\/\/www.coincenter.org\/a-new-senate-bill-focuses-on-cryptocurrency-exchanges-heres-what-developers-and-users-should-keep-an-eye-on\/\" target=\"_blank\" rel=\"noopener\">reportedly<\/a> seek to regulate and define brokers, dealers, custodians, and trading facilities. While semantic, these designations go a long way towards curtailing previous <a href=\"https:\/\/bitcoinmagazine.com\/industry-events\/infrastructure-bill-bitcoin-reckoning\">attempts<\/a> at regulating the ecosystem which resulted in <a href=\"https:\/\/bitcoinmagazine.com\/business\/us-senators-propose-bill-to-amend-bitcoin-tax-reporting\">mistaken definitions<\/a> that could have made operating in the space as a transaction validator or service provider extremely difficult \u2013 as seen in the previously introduced<a href=\"https:\/\/bitcoinmagazine.com\/markets\/infrastructure-bill-report-bitcoin-payments-over-10000-to-irs\"> infrastructure bill.<\/a> <\/p>\n<p>However, this bill reportedly includes an exclusion for \u201ca person\u201d if said person\u2019s involvement in the ecosystem is \u201csolely because that person validates digital commodity transactions.\u201d While this could be a boon for those not directly involved in the trading of bitcoin, there is still room for these definitions to get dicey. <\/p>\n<p>Furthermore, Democratic SAC Chairwoman Debbie Stabenow and leading Republican John Boozman of Arkansas plan to introduce the bill today.
