{"id":429587,"date":"2024-10-04T02:30:53","date_gmt":"2024-10-03T21:00:53","guid":{"rendered":"https:\/\/ambcrypto.com\/?p=429587"},"modified":"2024-10-04T08:38:15","modified_gmt":"2024-10-04T03:08:15","slug":"ripple-sec-case-appeal-irrational-misguided-from-the-start","status":"publish","type":"post","link":"https:\/\/ambcrypto.com\/ripple-sec-case-appeal-irrational-misguided-from-the-start\/","title":{"rendered":"Ripple &#8211; SEC case appeal: &#8216;Irrational, misguided from the start&#8217;"},"content":{"rendered":"<ul>\n<li><em>SEC has filed an appeal against Ripple&#8217;s decision, contesting secondary sales of XRP as non-securities transactions.<\/em><\/li>\n<li><em>Ripple executives criticized the SEC&#8217;s legal tactics, highlighting the lawsuit&#8217;s irrationality.<\/em><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">On the 2nd of October, the United States Securities and Exchange Commission (SEC) took a pivotal step by <a href=\"https:\/\/x.com\/FilanLaw\/status\/1841585433274204454\" target=\"_blank\" rel=\"noopener\">filing a notice<\/a> of appeal in the <a href=\"https:\/\/ambcrypto.com\/category\/xrp-ripple-news\/\" target=\"_blank\" rel=\"noopener\">Ripple [XRP]<\/a> lawsuit, aiming to overturn a recent ruling by Judge Analisa Torres.<\/span><\/p>\n<h2><strong>What was Judge Torres&#8217;s ruling all about?<\/strong><\/h2>\n<p>Legal experts predicted that the SEC would file an appeal following the 2023 verdict, which concluded that secondary sales of Ripple&#8217;s XRP do not qualify as securities transactions.<\/p>\n<p>So for those unaware, <a href=\"https:\/\/ambcrypto.com\/xrp-skyrockets-by-over-20-in-a-hour-as-judge-finalises-on-ripples-fine\/\" target=\"_blank\" rel=\"noopener\">Judge Torres concluded<\/a> that XRP, on its own, does not meet all the criteria of the SEC&#8217;s Howey test for investment contracts, ruling that secondary sales cannot be labeled as unregistered securities sales.<\/p>\n<p>However, she noted that Ripple&#8217;s founders&#8217; initial sales to institutional investors did qualify as securities sales.<\/p>\n<p>This landmark decision marked a significant victory for Ripple Labs and the broader cryptocurrency sector.<\/p>\n<h2><strong>Ripple&#8217;s execs criticize SEC&#8217;s move<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">However, the legal battle seems to be ongoing with the SEC&#8217;s recent notice of appeal, drawing criticism from various quarters, including Ripple\u2019s Chief Legal Officer, <a href=\"https:\/\/x.com\/s_alderoty\/status\/1841596012588114116\" target=\"_blank\" rel=\"noopener\">Stuart Alderoty<\/a>. <\/span><\/p>\n<p>In a post on X (formerly Twitter), Alderoty expressed disappointment over the SEC&#8217;s decision to appeal, calling it unsurprising but pitiful, as it only extends what he described as a significant embarrassment for the agency.<\/p>\n<p>He pointed out that,<\/p>\n<blockquote><p><span style=\"font-weight: 400;\">\u201cThe Court already rejected the SEC\u2019s suggestion that Ripple acted recklessly, and there were no allegations of fraud and, of course, there were no victims or losses.\u201d<\/span><\/p><\/blockquote>\n<p>Here, Alderoty explains that the agency, under its current chair, is using aggressive legal tactics against the cryptocurrency industry instead of adhering to legal principles and regulations.<\/p>\n<p><span style=\"font-weight: 400;\">Providing further insight on the matter, he noted,\u00a0<\/span><\/p>\n<blockquote><p><span style=\"font-weight: 400;\">\u201cWe are evaluating whether to file a cross appeal.
