{"id":401370,"date":"2024-06-22T21:30:38","date_gmt":"2024-06-22T16:00:38","guid":{"rendered":"https:\/\/ambcrypto.com\/?p=401370"},"modified":"2024-06-22T15:26:44","modified_gmt":"2024-06-22T09:56:44","slug":"fight-isnt-over-despite-sec-closing-ethereum-2-0-probe-exec","status":"publish","type":"post","link":"https:\/\/ambcrypto.com\/fight-isnt-over-despite-sec-closing-ethereum-2-0-probe-exec\/","title":{"rendered":"&#8216;Fight isn&#8217;t over,&#8217; despite SEC closing Ethereum 2.0 probe &#8211; Exec"},"content":{"rendered":"<ul>\n<li><em>SEC concluded its 14-month Ethereum 2.0 probe without charging Consensys<\/em><\/li>\n<li><em>Consensys asserts that the fight continues, with two more SEC probes being contested<\/em><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The long-standing l<a href=\"https:\/\/ambcrypto.com\/sec-ethereum-2-0-investigation-closes-silly-to-begin-with\/\" target=\"_blank\" rel=\"noopener\">egal battle<\/a> between the United States Securities and Exchange Commission (SEC) and Consensys, the firm behind the MetaMask wallet, appears to have finally come to an end. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">For nearly 14 months, the SEC had been investigating <a href=\"https:\/\/ambcrypto.com\/category\/ethereum-news\/\" target=\"_blank\" rel=\"noopener\">Ethereum [ETH]<\/a> 2.0 and Consensys.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For context, Ethereum 2.0 refers to the post-Merge era when the network transitioned from Proof of Work (PoW) to Proof of Stake (PoS). However, according to Consensys, the battle is far from over.\u00a0<\/span><\/p>\n<h2>Impact of SEC ending the investigation into ETH 2.0<\/h2>\n<p><span style=\"font-weight: 400;\">This development has sent ripples through the entire crypto community, raising the crucial question &#8211; What impact will this have on the broader industry?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Commenting on the issue, <a href=\"https:\/\/www.cnbc.com\/video\/2024\/06\/21\/consensys-head-of-litigation-provides-new-details-after-sec-closes-probe-into-crypto-firm.html\" target=\"_blank\" rel=\"noopener\">Laura Brookover<\/a>, Head of Litigation &amp; Investigations at Consensys, told CNBC,\u00a0<\/span><\/p>\n<blockquote><p><span style=\"font-weight: 400;\">&#8220;Well, we were very pleased, to receive the letter noting that the investigation into Ethereum 2.0 has been concluded, and that it was concluded without charges against Consensys.&#8221;<\/span><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">She added,\u00a0<\/span><\/p>\n<blockquote><p><span style=\"font-weight: 400;\">\u201cIt\u2019s the right result, it\u2019s the result that should have happened, a year ago. But of course, the fight isn&#8217;t over yet.\u201d\u00a0<\/span><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">Brookover also emphasized that the Ethereum investigation is just one of three separate probes that Consensys is currently challenging in its lawsuit in Texas.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">She pointed out that these investigations are a significant part of the legal action they have undertaken to protect their operations and the broader Ethereum ecosystem.<\/span><\/p>\n<h2>The story so far&#8230;<\/h2>\n<p><span style=\"font-weight: 400;\">This all started way back in 2018 when the SEC alluded that Ether was not a security. However, in 2023, the SEC quietly changed its position, asserting authority over Ether as a security and launching an investigation into Ethereum.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This prompted Consensys to file a lawsuit against the SEC on <a href=\"https:\/\/ambcrypto.com\/ethereum-consenys-vs-sec-an-unlawful-power-grab-or-a-cover-up\/\" target=\"_blank\" rel=\"noopener\">25 April 2024<\/a>, with an aim to protect the Ethereum ecosystem. It fails to explain why the SEC closed the investigation and how this decision impacts other ongoing investigations and enforcement actions.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This leaves many questions unanswered and underscores the need for clearer regulatory guidelines in the rapidly evolving cryptocurrency landscape.
