{"id":380044,"date":"2024-03-28T18:00:39","date_gmt":"2024-03-28T12:30:39","guid":{"rendered":"https:\/\/ambcrypto.com\/?p=380044"},"modified":"2024-05-07T12:14:05","modified_gmt":"2024-05-07T06:44:05","slug":"ripple-exec-calls-for-a-quick-knock-out-punch-in-sec-vs-coinbase","status":"publish","type":"post","link":"https:\/\/ambcrypto.com\/ripple-exec-calls-for-a-quick-knock-out-punch-in-sec-vs-coinbase\/","title":{"rendered":"Why this Ripple exec is calling for a &#8216;quick knockout punch&#8217; against&#8230;"},"content":{"rendered":"<ul>\n<li style=\"font-weight: 400;\"><em><span style=\"font-weight: 400;\">Self-custodial wallets get a \u201cwin\u201d in Coinbase vs SEC lawsuit.\u00a0<\/span><\/em><\/li>\n<li style=\"font-weight: 400;\"><em><span style=\"font-weight: 400;\">The industry still seeks wider regulatory clarity.\u00a0<\/span><\/em><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">On the 27th of March, US District Judge Katherine Failla greenlighted the SEC\u2019s lawsuit against Coinbase to proceed but dismissed claims against Coinbase Wallet.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In the <\/span><a href=\"https:\/\/assets.ctfassets.net\/c5bd0wqjc7v0\/31xgWFLYsKNgu6YQqzkE3\/e720ef7fc1fdf2edfd76f4525d851256\/SEC_v._Coinbase__Opinion_and_Order_3.27.24.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">decision<\/span><\/a><span style=\"font-weight: 400;\">, Judge Failla dismissed the SEC&#8217;s alleged claim that Coinbase was an unregistered broker through its Coinbase Wallet.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The court noted that Coinbase had no control over users\u2019 crypto or transactions in the wallet.\u00a0<\/span><\/p>\n<h4>A win for self-custodial crypto wallets<\/h4>\n<p><span style=\"font-weight: 400;\">Coinbase\u2019s partial win has been heralded across the industry, starting with Coinbase\u2019s executives.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Acknowledging the judge\u2019s decision, Paul Grewal, Coinbase&#8217;s chief legal officer, <\/span><a href=\"https:\/\/twitter.com\/iampaulgrewal\/status\/1772993916146479193\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">noted<\/span><\/a><span style=\"font-weight: 400;\"> that they were ready for Coinbase Wallet&#8217;s alleged claims.\u00a0<\/span><\/p>\n<blockquote><p><span style=\"font-weight: 400;\">\u201cToday, the Court decided that our SEC case will move forward on most of the claims, but dismissed the claims against Coinbase Wallet. We were prepared for this, and we look forward to uncovering more about the SEC\u2019s internal views and discussions on crypto regulation.\u201d<\/span><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">Grewal added, \u201cWe also appreciate the Court\u2019s understanding that technology innovations like Coinbase Wallet do not and cannot implicate US securities laws.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ripple also supported Coinbase&#8217;s partial legal win. Ripple\u2019s chief legal officer, Stuart Alderoty, <\/span><a href=\"https:\/\/twitter.com\/s_alderoty\/status\/1773017299831648339\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">noted<\/span><\/a><span style=\"font-weight: 400;\"> that,<\/span><\/p>\n<blockquote><p>&#8220;A quick knock out punch would have been nice, but at the end of the day, the wheels of justice move slowly&#8221;<\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">He also added that the fight is \u201cfar from over.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">On his part, Brian Armstrong, CEO and co-founder of Coinbase, deemed the decision a win for self-custodial wallets;\u00a0<\/span><\/p>\n<blockquote><p><span style=\"font-weight: 400;\">\u201cGreat progress on the SEC case &#8211; and a huge win for self-custodial wallets.\u201d<\/span><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">But the CEO added,\u00a0<\/span><\/p>\n<blockquote><p><span style=\"font-weight: 400;\">\u201cWe&#8217;ll continue fighting for your right to use crypto and to get clarity around the rules until the job is done.\u201d<\/span><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">Coinbase\u2019s vice president of product, Max Branzburg, reiterated Armstrong\u2019s sentiment, <\/span><a href=\"https:\/\/twitter.com\/brian_armstrong\/status\/1773015852503417100\"><span style=\"font-weight: 400;\">calling<\/span><\/a><span style=\"font-weight: 400;\"> the dismissal \u201ca win for the industry.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Branzburg added that the move could be a check against \u201cSEC overreach and protecting self-custody in America.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Self-custody wallets entrust full control to users, granting them their own private keys.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Compared to the recent EU AMLR (Anti Money Laundering Regulations) update, regulation for self-custody wallets in the US could be deemed \u201clenient.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Peter Hansen, strategy and policy director for Circle EU, <\/span><a href=\"https:\/\/twitter.com\/paddi_hansen\/status\/1771929879073771974\"><span style=\"font-weight: 400;\">noted<\/span><\/a><span style=\"font-weight: 400;\"> that the previous version of the AMLR was very strict.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It required a KYC (Know Your Customer) originator\/beneficiary for self-custodial wallets.
