Don&#8217;t bet on it, BUT&#8230;"},"content":{"rendered":"<ul>\n<li><i>SEC was looking to label ETH as a security per a recent investigation.<\/i><\/li>\n<li><i>Lack of communication between applicants and the regulator was concerning.<\/i><\/li>\n<\/ul>\n<p><a href=\"http:\/\/ambcrypto.com\/category\/bitcoin-news\/\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\">Bitcoin [BTC]<\/a> may have seen the light of day but the second-largest cryptocurrency, <a href=\"http:\/\/ambcrypto.com\/category\/ethereum-news\/\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\">Ethereum [ETH]<\/a>, may not be as lucky to get its widely-anticipated spot exchange-traded funds (ETFs) approved in the U.S.<\/p>\n<h4><strong>No ETH spot ETFs in May?<\/strong><\/h4>\n<p>Alex Thorn, Head of Research at Galaxy Digital, <a href=\"https:\/\/x.com\/glxyresearch\/status\/1771300295479377938?s=20\" target=\"_blank\" rel=\"noopener\">said<\/a> that the chances of approval in May &#8211; the final deadline for the first list of ETF applications &#8211; was &#8220;extremely unlikely.&#8221;<\/p>\n<p>The pessimistic projection stemmed from the unfriendly stance taken by the U.S. Securities and Exchanges Commission (SEC), which was reviewing numerous applications for an ETH ETF.<\/p>\n<h4><strong>SEC at odds with ETH?<\/strong><\/h4>\n<p>The biggest contributor to the negative sentiment was a recent <a href=\"http:\/\/ambcrypto.com\/us-sec-reportedly-gearing-up-to-classify-ethereum-eth-as-a-security\/\" target=\"_blank\" rel=\"noopener\">report<\/a> by global business media company, Fortune, revealing a major push by the SEC to get Ether labeled as a security.<\/p>\n<p>Fortune reported that the regulator also served subpoenas to several companies in recent weeks as part of an investigation into the Ethereum Foundation &#8211; a non-profit organization that supports Ethereum and related technologies.<\/p>\n<p>The SEC&#8217;s stance on ETH has been murky, with top executives, including SEC Chair Gary Gensler, carefully <a href=\"https:\/\/www.youtube.com\/watch?v=lcHBwFKzVHY\" target=\"_blank\" rel=\"noopener\">avoiding<\/a> the subject of whether ETH is a security or commodity.<\/p>\n<p>The ambiguity perhaps also reflected in the lack of dialogue between the ETF applicants and regulator, highlighted previously in an AMBCrypto <a href=\"http:\/\/ambcrypto.com\/crypto-market-weekly-winners-and-losers-10-march\/\" target=\"_blank\" rel=\"noopener\">report<\/a> as well. This was quite unlike the approval process of Bitcoin ETFs, during which the SEC regularly engaged with the issuers.<\/p>\n<p>Back in January, British multinational bank Standard Chartered had <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2024-01-30\/sec-is-likely-to-approve-ethereum-etf-in-may-standard-chartered-predicts-eth\" target=\"_blank\" rel=\"noopener external noreferrer nofollow\" data-wpel-link=\"external\">predicted<\/a> an Ether ETF approval by the 23rd of May, the final deadline for the first list of applications. However, with each passing day, the odds in favor of approval were shrinking<\/p>\n<hr \/>\n<p style=\"text-align: center;\">Is your portfolio green? Check out the\u00a0<a href=\"http:\/\/ambcrypto.com\/calculator\/ethereum-profit-calculator\" target=\"_blank\" rel=\"noopener\" data-wpel-link=\"internal\">ETH Profit Calculator<\/a><\/p>\n<hr \/>\n<p style=\"text-align: left;\">Meanwhile, the SEC <a href=\"https:\/\/x.com\/WuBlockchain\/status\/1771340558306508812?s=20\" target=\"_blank\" rel=\"noopener\">deferred<\/a> its decision on whether to approve an ETH futures ETF by Grayscale &#8211; world&#8217;s largest digital asset manager.
