{"id":355188,"date":"2023-11-01T15:00:56","date_gmt":"2023-11-01T09:30:56","guid":{"rendered":"https:\/\/ambcrypto.com\/?p=355188"},"modified":"2023-11-28T17:14:43","modified_gmt":"2023-11-28T11:44:43","slug":"happy-anniversary-bitcoin-says-gary-gensler-draws-ire","status":"publish","type":"post","link":"https:\/\/ambcrypto.com\/happy-anniversary-bitcoin-says-gary-gensler-draws-ire\/","title":{"rendered":"&#8216;Happy anniversary, Bitcoin,&#8217; says Gary Gensler &#8211; draws ire"},"content":{"rendered":"<ul>\n<li><em>Gary Gensler cautioned crypto firms \u201ctricking investors\u201d to comply with securities laws.<\/em><\/li>\n<li><em>The post led to sharp digs and a few speculations.<\/em><\/li>\n<\/ul>\n<p>On 31 October, the US Securities and Exchange Commission (SEC) Chair Gary Gensler posted a congratulatory message as Bitcoin [BTC] completed 15 years, evoking Satoshi Nakamoto\u2019s famous white paper.<\/p>\n<p>In the same breath, he cautioned crypto firms, which were seemingly \u201ctricking investors,\u201d to comply with securities laws.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">If Satoshi Nakamoto went as Satoshi Nakamoto for Halloween, would we be able to tell?<\/p>\n<p>Happy 15th anniversary to Satoshi\u2019s famous white paper that started crypto.<\/p>\n<p>Any crypto companies that are tricking investors should start treating them to compliance with the securities laws.<\/p>\n<p>\u2014 Gary Gensler (@GaryGensler) <a href=\"https:\/\/twitter.com\/GaryGensler\/status\/1719393827620876406?ref_src=twsrc%5Etfw\">October 31, 2023<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>Gensler\u2019s post was indicative of his long-held position, as per which, crypto assets can only operate in the US if they are classified as securities and are subject to the SEC\u2019s regulation.<\/p>\n<p>Only last week, Gensler had <a href=\"https:\/\/www.sec.gov\/news\/speech\/gensler-remarks-securities-enforcement-forum-102523\" target=\"_blank\" rel=\"noopener\">mentioned<\/a> Satoshi\u2019s iconic paper in a speech slamming the crypto industry as being rife with \u201cfraud, scams, bankruptcies, and money laundering.\u201d<\/p>\n<h4>Ripple counsel takes a dig at Gensler<\/h4>\n<p>Gensler\u2019s latest tweet drew sharp reactions from different corners.<\/p>\n<p>Ripple&#8217;s [XRP] chief counsel Stuart Alderoty was quick to retort. He said that while Gensler was posting \u201cbad Halloween jokes,\u201d his agency is being condemned for not being accountable to the US Congress.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">While Mr. Gensler is making bad Halloween jokes on X, his agency is being shamed for ignoring the law that requires agency rules to be reviewed by Congress. Seems the SEC has become the lawless Wild West Gensler loves to talk about so much. <a href=\"https:\/\/t.co\/WTkyRhyrLy\">https:\/\/t.co\/WTkyRhyrLy<\/a><\/p>\n<p>\u2014 Stuart Alderoty (@s_alderoty) <a href=\"https:\/\/twitter.com\/s_alderoty\/status\/1719426290728456670?ref_src=twsrc%5Etfw\">October 31, 2023<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>Alderoty retweeted a recent post by the US Government Accountability Office\u00a0that <a href=\"https:\/\/www.gao.gov\/products\/b-334540?utm_medium=social&amp;utm_source=twitter&amp;utm_campaign=usgao\" target=\"_blank\" rel=\"noopener\">criticized<\/a> the SEC\u2019s decision to not submit a crypto-related bulletin report to Congress. The SEC, in its defense, said the bulletin is neither an agency action nor a binding agency statement.<\/p>\n<p>During Gensler\u2019s stint, the SEC has <a href=\"http:\/\/ambcrypto.com\/breaking-us-sec-sues-the-worlds-largest-crypto-exchange-binance\/\" target=\"_blank\" rel=\"noopener\">taken action<\/a> <a href=\"http:\/\/ambcrypto.com\/sec-sues-coinbase-will-these-tokens-get-caught-in-the-crossfire\/\" target=\"_blank\" rel=\"noopener\">against<\/a> multiple crypto firms such as Binance [BNB], Coinbase [COIN] for allegedly violating securities laws in the US.<\/p>\n<p>Gary Gensler\u2019s critics in the industry refer to his policy towards crypto as \u201cregulation by enforcement.\u201d<\/p>\n<p>In the last few months, the agency has partially lost court cases against <a href=\"http:\/\/ambcrypto.com\/sec-vs-ripple-the-final-ruling-is-here-and-this-is-what-it-means\/\" target=\"_blank\" rel=\"noopener\">Ripple<\/a> and <a href=\"http:\/\/ambcrypto.com\/us-sec-will-not-appeal-court-decision-on-grayscales-spot-bitcoin-application-report\/\" target=\"_blank\" rel=\"noopener\">Grayscale<\/a>.<\/p>\n<h4>Speculations around Bitcoin ETF approval abound<\/h4>\n<p>Gensler\u2019s tweet also led to speculations that the SEC was looking at the applications of spot Bitcoin exchange-traded funds (ETFs) positively. However, it was interesting that crypto is in the mind of the securities regulator\u2019s chairman, he added.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">Ha no read on this from us, just a little \u201cregulatory humor\u201d altho interesting that this is what is on his mind<\/p>\n<p>\u2014 Eric Balchunas (@EricBalchunas) <a href=\"https:\/\/twitter.com\/EricBalchunas\/status\/1719427605965762983?ref_src=twsrc%5Etfw\">October 31, 2023<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>Gensler <a href=\"http:\/\/ambcrypto.com\/sec-weighing-bitcoin-etf-applications-says-gary-gensler\/\" target=\"_blank\" rel=\"noopener\">told<\/a> Bloomberg last month that his agency was reviewing multiple Bitcoin ETF applications.<\/p>\n<h4>15 years since Satoshi\u2019s Bitcoin white paper<\/h4>\n<p>Satoshi\u2019s white paper was published 15 years ago on 31 October 2008. It outlined the basic structure of the Bitcoin network, a financial network without any centralized financial institutions or third parties.<\/p>\n<p>Since then, the crypto market has come a long way.
