(@FilanLaw) <a href=\"https:\/\/twitter.com\/FilanLaw\/status\/1689387153812230144?ref_src=twsrc%5Etfw\">August 9, 2023<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p>To give context, an interlocutory appeal is an appeal of a non-final order issued during the course of litigation.<\/p>\n<h4>Adding fuel to the fire<\/h4>\n<p>Attorney Jeremy Hogan took to X (formerly known as Twitter) and questioned the SEC&#8217;s latest decision. He also clarified the SEC&#8217;s intent behind filing for the appeal.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">AND&#8230; the SEC continues making questionable decisions, requesting an interlocutory appeal.<\/p>\n<p>Note that it is NOT appealing whether XRP itself is a security &#8211; just its losses on the programmatic and individual sales issues. <a href=\"https:\/\/t.co\/GziVLp23mT\">https:\/\/t.co\/GziVLp23mT<\/a><\/p>\n<p>\u2014 Jeremy Hogan (@attorneyjeremy1) <a href=\"https:\/\/twitter.com\/attorneyjeremy1\/status\/1689391038954123264?ref_src=twsrc%5Etfw\">August 9, 2023<\/a><\/p><\/blockquote>\n<p><script src=\"https:\/\/platform.twitter.com\/widgets.js\" async=\"\" charset=\"utf-8\"><\/script><\/p>\n<p>Although Ripple&#8217;s CEO Brad Garlinghouse had no response to the SEC&#8217;s latest move, the payment provider&#8217;s Chief Legal Officer responded.<\/p>\n<p>Stuart Alderoty took to X (formerly known as Twitter) to respond to the SEC&#8217;s letter. As per the <a href=\"http:\/\/ambcrypto.com\/ripple-is-there-an-end-in-sight-to-xrps-bearish-bias\/\">Ripple<\/a> executive, the SEC doesn&#8217;t have the right to appeal which justified the SEC seeking permission to file the interlocutory appeal.<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">The SEC does not have the \u201cright\u201d to appeal just yet which is why they are asking permission to file an \u201cinterlocutory\u201d appeal. Ripple will file its response with the Court next week. Additionally, XRP made some strides and was trading 0.45% higher in the last hour.
