{"id":320718,"date":"2023-06-15T18:00:31","date_gmt":"2023-06-15T12:30:31","guid":{"rendered":"https:\/\/ambcrypto.com\/?p=320718"},"modified":"2023-06-15T16:34:12","modified_gmt":"2023-06-15T11:04:12","slug":"celsius-submits-revised-bankruptcy-plan-after-fahrenheit-deal","status":"publish","type":"post","link":"https:\/\/ambcrypto.com\/celsius-submits-revised-bankruptcy-plan-after-fahrenheit-deal\/","title":{"rendered":"Celsius submits revised bankruptcy plan after Fahrenheit deal"},"content":{"rendered":"<ul>\n<li><em>Celsius\u2019 plan needs to be approved by the New York bankruptcy court.<\/em><\/li>\n<li><em>Fahrenheit won the bid to acquire Celsius&#8217; assets after a lengthy auction process.<\/em><\/li>\n<\/ul>\n<p>Defunct crypto lender Celsius has <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysb.312902\/gov.uscourts.nysb.312902.2807.0.pdf\" target=\"_blank\" rel=\"noopener\">submitted<\/a> an updated bankruptcy plan to reflect the Fahrenheit consortium\u2019s successful bid for its assets.<\/p>\n<p>Fahrenheit, a consortium of buyers led by venture capital firm Arrington Capital and crypto miner U.S. Bitcoin Corp, was <a href=\"https:\/\/cases.stretto.com\/public\/x191\/11749\/PLEADINGS\/1174905252380000000034.pdf\" target=\"_blank\" rel=\"noopener\">declared<\/a> the winning bidder last month. Fahrenheit was picked as the winning bidder after a lengthy auction process.<\/p>\n<p>It defeated NovaWulf\u2019s bid for the company\u2019s assets which were previously valued at roughly $2 billion.<\/p>\n<p>Celsius\u2019 plan, filed on 15 June, must be approved by the New York bankruptcy court supervising the wind-up, and is facing opposition from the creditors.<\/p>\n<p>This new venture will receive liquid crypto assets worth $450-$500 million as a part of the Fahrenheit deal. The U.S. Bitcoin Corp will build a variety of crypto mining facilities, including a new 100-megawatt facility.<\/p>\n<p>Fahrenheit is set to acquire Celsius Network\u2019s institutional loan portfolio, staked crypto assets, mining units and other alternative enterprises. Celsius&#8217; assets were originally estimated at more than $2 billion.<\/p>\n<h4>Violation of consumer lending law, claims lawyer<\/h4>\n<p>\u201cThis proposed treatment violates every consumer lending law out there,\u201d <a href=\"https:\/\/twitter.com\/DavidJAdler1991\/status\/1669219237104058368\" target=\"_blank\" rel=\"noopener\">tweeted<\/a> David Adler of law firm McCarter &amp; English. He said that the group of borrowers he represents in the case will oppose the plan because Celsius won\u2019t return their collateral.<\/p>\n<p>Adler noted that the Celsius group must demonstrate that they are progressing the case and talking with stakeholders in order to retain the sole right to propose a bankruptcy plan. He added that his clients were ignored and \u201ctreat[ed] like mushrooms for the past seven weeks.\u201d<\/p>\n<p>Celsius\u00a0<a href=\"https:\/\/cases.stretto.com\/public\/x191\/11749\/PLEADINGS\/1174905252380000000034.pdf\" target=\"_blank\" rel=\"noopener\">filed for<\/a>\u00a0bankruptcy in July 2022 following a sharp decline in the value of crypto assets.
